He won't win.
I had the same thing happen on a Vette several years ago - I won a C5 for 22K and it was worth 30. The dealer sent me a note congratulating me for wining the auction and then the next morning when I called to arrange the sale he said that someone else had bought it off the lot, but they didn't get the auction closed in time. The dealer was about 50 miles away so I drove over there, took pictures of the car still for sale on the lot, and talked to the manager. The car was still for sale. A slight argument ensued and I filed a protest with a eBay and Square Trade claims. I didn't get the car or any money from anybody, but I did get them booted off eBay. |

I've bought two cars that I have seen listed on eBay, but I would never buy a car through eBay.
You are usually bidding against the dealer anyway. eBay has taken chandelier bids to a new high. |

Buyers do the same thing in reverse to dealers. Ebay Motors is a place to view inventory and get started. Sure you could sue, but it's probably not going to be worth it in the end.
