I had the same thing happen on a Vette several years ago - I won a C5 for 22K and it was worth 30. The dealer sent me a note congratulating me for wining the auction and then the next morning when I called to arrange the sale he said that someone else had bought it off the lot, but they didn't get the auction closed in time.

The dealer was about 50 miles away so I drove over there, took pictures of the car still for sale on the lot, and talked to the manager. The car was still for sale. A slight argument ensued and I filed a protest with a eBay and Square Trade claims. I didn't get the car or any money from anybody, but I did get them booted off eBay.

I've bought two cars that I have seen listed on eBay, but I would never buy a car through eBay.

You are usually bidding against the dealer anyway.

eBay has taken chandelier bids to a new high.

I beg to differ. The terms of service for ebay state that its a binding contract.

If he sued he would win.

Whenever I see an item that I want to bid on, I simply place my bid, with a bit of room for price rise, in the final 30 seconds of the auction. As others would call "sniping"

Case in point, I just got my 3rd set of tires from the same seller. The first two times I simply did the Buy it Now because I needed them. This final set of 4, which just arrived today, I sniped and paid considerably less for them. Best part is that they are easily the best scrub tires I've ever purchased. Easily 95% of original tread depth.

I will never place another bid on an item during the regular course of bidding.

Buyers do the same thing in reverse to dealers. Ebay Motors is a place to view inventory and get started. Sure you could sue, but it's probably not going to be worth it in the end.

There's been similar cases like this, some much more extreme in difference between market value and winning bid amount.

The dealers almost always cave once the story goes viral on the forums. The dealer fuked up by not setting a reserve price...That is not the bidder's fault.

Suing isn't the answer, let the forums work for you...It doesn't take much for the internet backlash to become overwhelming for a dealer when stories like this circulate.
