The lawsuit, filed Monday in U.S. District Court, alleges Disneyland violated the Americans With Disabilities Act because it didn't have proper procedures in place for evacuating disabled passengers from the ride.

Jose Martinez is also suing for negligence, emotional distress and liability.

He alleges Disney employees did not summon paramedics when his blood-pressure spiked while he was trapped on the ride.

Disneyland Resorts says in a statement it is accessible to all guests and has procedures in place for evacuating disabled customers.

There isn't a judge or jury in the world that could deny this man his justice.

My wife and I went to WDW on our honeymoon in '95. We got stuck on the same ride for almost an hour.

The song NEVER STOPPED!!!

Now when I hear the song, I get a nervous tick....

40 minutes stranded on that ride listening to It's a Small World, and I'd confess to kidnapping the Lindbergh baby, blowing up the Hindenburg, and taking out Jimmy Hoffa.

If I recall that ride is on water... Did the guy take swimming lessons before embarking on said ride? What if he fell out? Was he wearing a life vest? Sounds like he didnt take reasonable precautions before even setting foot on that ride!

You just never know the real story in these cases. For all we know, there was a safe and easy way to evacuate the guy, but he refused it.

I am always skeptical when people want to sue for "emotional distress". What the guy considers a suitable evacuation plan, is not necessarily what the state requires....

And personally, if he brings that law suit, then he should never ever be allow to step foot in another Disney world again. You would be surprised how many people sue someone and then turn around and try and obtain the same services from the same people or company ....

Sadly, my guess is that this end result of this law suit is that Disney will stop allowing wheel chairs on most rides. There is no requirement that they make any ride wheel chair accessible. They simply do it because they want to make it fun for everyone.

I am sorry it took 40 minute of this guys life, but damn.... Aren't there worse things in life.

I'd like to kick the guy in the balls that's responsible for that torture of a ride.

I haven't been to Dizzyland in 40 years and that song still haunts me.
