Illinois Attorney General Lisa Madigan is defending the decision by her public access counselor that would make public the names of those who have Firearm Owners Identification cards. Madigan says staff in her office examined case law when making the decision to make public the names of FOID card holders and the cards’ expiration dates. She says changes to the Freedom of Information Act allows for a public access counselor to review denied FOIA requests and determine, based on previous court rulings, if the denial was legitimate.

The matter came to the attorney general’s office from the Associated Press, which requested the names of FOID card holders from the state police. When they were denied, the AP appealed to the public access counselor for an opinion. While opponents say the findings break a promise of privacy between the state and gun owners, Madigan says there was nothing in writing to that effect. “We look at the actual statute, we look at any case law that is relevant and in those circumstances as we’ve done here, the FOID Card Act does not require that that information is private, so there’s no provision in the law for that,” Madigan said. “The federal and state courts that have looked at these issues have essentially said that when you apply for some form of a license that that is public information.” As for a potential challenge in court, Madigan says it depends on what the Illinois State Police decide to do as far as releasing the information. The state police issue the cards and keep a database of gun owners. :beat: :slap: :kick:

I want out of this cesspool state so bad I am even considering taking a $20,000 loss on my home to do it. However, my step dad's health is failing and I am the only family he has left other than his sister who is older than him. So, here in Hellinois I stay.

We have the most corrupt state in the union. The governor just raised the individual income tax rate by about 66% as a necessity to avert the state’s “fiscal emergency,” which includes a budget deficit of more than $13 billion, about $8 billion in unpaid bills to social service agencies, pharmacies and others, and a sinking bond rating. Businesses in Illinois, which will face a business tax rate increase of 46%. The governor is also trying to borrow $8.75 billion to help pay for these debts. CCW will never happen. Fuel,cigarette,liquor,beer and food taxes are higher too. Glad we work in MO and we get what we can before we cross back into hell.

I agree. We have been looking,but with my job it is tough to find another one without taking a big hit. Plus,most of the family is here.

We have been lightly looking. With where we live now,we are about 35-40 minutes north of STL and in the country and we don't have to go thru any big towns or STL since we work on the north side of STL. If we move we want to find some acreage,so we would have to move about an hour out to find any land and have to deal with traffic on the interstates. :willy:

As a law abiding citizen, I have no problem letting the entire planet know I have a Gun in my home; especially the non-law abiding citizens.

Problem is letting them know which ones do also tells them which ones don't or at least increases the chances they don't. It's like staking down a sheep to attract a wolf.

I wanted to add to the bottom of our ADT sign "Backed up by Smith & Wesson" but my wife had a fit.

What i would like to know is why Associated Press filed a "Freedom of Info Act" claim to get the FOID owners info anyways. Not that I give a shit about our dopey AG but someone else initiated this whole thing.

You are right I am afraid for my money as I am taxed enough already and the mob in DC is spending us into the next universe and with the mob in charge of 2/3 of the law/spending in DC not much chance of getting rid of those 1 trillion $$ deficits anytime soon:shots:

Naturally those who actually live in Illinois long enough know the real story behind this, and it's a little late coming. Illinois is still paying for the all the Lawsuits from the early 90s when people were wrongfully sentence to death. Basically ... if you're not good at something and it's costing you Millions to continue to that screw-up, intelligence only dictates that you spare the Tax Payer the cost. Of course people who critique State Deficits never do a true complete postmortem on balances brought forward.

CHICAGO (AP) — Democratic Gov. Pat Quinn intends Wednesday to abolish Illinois' death penalty more than a decade after one of his Republican predecessors enacted a moratorium that has prevented executions for the last 11 years, two lawmakers said.

Quinn's office confirmed early Wednesday that the governor would announce his decision on legislation to end capital punishment in the state. Two sponsors of the measure, State Rep. Karen Yarbrough and state Sen. Kwame Raoul, said they were invited to witness the governor sign the bill on Wednesday.

"It's going to happen," Raoul said Tuesday.

Quinn's signature would make Illinois the 16th state without capital punishment when it takes effect July 1. But a decision to sign has not come easily.

Quinn's office declined to comment Tuesday about his intentions, but he has said he personally supports the death penalty when properly implemented and would make a decision on the bill based on his conscience.

"I've heard from many, many people of good faith and good conscience on both sides of the issue. And I've tried to be very meticulous and writing down notes and studying those notes and books and e-mails. They've really spoken from the heart. I've been very proud of the people of Illinois," Quinn said recently.

Among those the governor consulted with were prosecutors, murder victims' families, death penalty opponents and religious leaders. Quinn even heard from retired Anglican Archbishop Desmond Tutu of South Africa and met with Sister Helen Prejean, the inspiration for the movie "Dead Man Walking."

Illinois Attorney General Lisa Madigan appealed directly to Quinn to veto the bill, as did several county prosecutors and victims' families. They said safeguards, including videotaped interrogations and easier access to DNA evidence, were in place to prevent innocent people from being wrongly executed.

But death penalty opponents argued that there was still no guarantee that an innocent person couldn't be put to death. Even Quinn's own lieutenant governor, Sheila Simon, a former southern Illinois prosecutor, asked him to abolish capital punishment.

Illinois' last execution was in 1999, a year before then-Gov. George Ryan imposed a moratorium on capital punishment after the death sentences of 13 men were overturned. Ryan cleared death row before leaving office in 2003 by commuting the death sentences of 167 inmates to life in prison.

If Quinn were to sign the bill, it is unclear how that would affect the 15 inmates currently on Illinois' death row.

New Mexico was the most recent state to repeal the death penalty, in 2009, but new Republican Gov. Susana Martinez wants to reinstate it. The District of Columbia also doesn't have the death penalty.

Prosecutors would still be able to seek the death penalty and juries could still impose it until the law took effect.
