Obama lawyers: Citizens targeted if at war with US

U.S. citizens are legitimate military targets when they take up arms with al-Qaida, top national security lawyers in the Obama administration said Thursday.


The lawyers were asked at a national security conference about the CIA killing of Anwar al-Awlaki, a U.S. citizen and leading al-Qaida figure. He died in a Sept. 30 U.S. drone strike in the mountains of Yemen.

The government lawyers, CIA counsel Stephen Preston and Pentagon counsel Jeh Johnson, did not directly address the al-Awlaki case. But they said U.S. citizens do not have immunity when they are at war with the United States.

Johnson said only the executive branch, not the courts, is equipped to make military battlefield targeting decisions about who qualifies as an enemy.

The courts in habeas cases, such as those involving whether a detainee should be released from the Guantanamo Bay detention facility in Cuba, make the determination of who can be considered an enemy combatant.

Late last year, a judge threw out a lawsuit filed by al-Awlaki's father, saying that the courts do not have the authority to review military decisions by the president aimed at protecting the country from terrorists. The cleric's father, Nasser al-Awlaki of Yemen, was suing to prevent the U.S. from targeting his son.

I really don't think too many people are going to have a problem with this ruling.

Obama got it right.

Interestingly, I've seen some conservatives take the liberal stance in speaking against this.

I can't open the link for some reason...

Does it say anything about WHERE they are? If they are American citizens on American soil it is a completely different thing than if they are in some camp in Afghanistan.

American citizen on American soil = NOT a military target. As screwed up as it might be at times, we have due process for a reason. If they are over in some camp somewhere... :thehandle:

But what if they are on US soil but attacking a military target?

If that was the case, they should be handled exactly like anybody else would be. We have protocols, rules of engagement, escalation of force rules, force protection procedures, etc that address pretty much any scenario that you could imagine.

If they are in the act of physically attacking a military target, then the appropriate force should be used in stopping that attack... whatever that might be. If it is a situation that calls for deadly force, by all means, take the mofos out and figure out their citizenship when they are cold and on the ground.

I'm only skeptical of the definition of "at war." As an American citizen, I don't think I should ever have even the slightest, remote chance of worrying that I could be mistaken for a terrorist and killed by the government without a fair trial.

FDR executed an American Citizen who served as a spy for Germany during WWII,

If you take up arms against the USA you should die. Simple.

think for a nanosecond that islamics don't have spies in our institutions??
