IMO, the estate should be split evenly after it's all liquidated. Family businesses and strings attached are messy, as everybody has pretty much stated. BTDT and it's not fun.

Here's a story of a family with 3 siblings. All married. Two siblings very well off, doctors/lawyers kind of well off. 3rd is self employed, spouse is a school principal. Nobody's hurting in the family, but two professional siblings obviously are doing much better.

One parent needed live in care for several years, cost split by two larger earner siblings. The other sibling for years has handled the needs of both parents....home repairs, dealing with car repairs, medical appointments, mowing the grass, and now, getting the weekly groceries and generally just making sure surviving parent is OK. Doing the honey dos. Decades ago, when the house flooded twice, it was the self employed sibling and his friends, me included, that mucked out the house and did the other stuff you have to do after a flood.

So I guess the main asset of the parents at this point is the house....nice, lake front. Everyone in the family agrees that the house will go to the self employed sibling, none of them would need any inheritance, it wouldn't really change any of their lifestyles, and the two wealthier siblings agree this validates the other siblings "in the trenches" approach to caring for the parents over the decades, despite them shelling out a shitload of money for a live in caregiver for several years. They tossed money at the problem, vs. their time, because that's what they were able to contribute, whereas the other sibling lived close by and was able to contribute the hands on stuff.

Is that fair? I don't know, but it's nice that everyone agrees and there won't be any bad feelings or animosity when the time comes. I think that's worth quite a lot.

The sister is still family. Would you prefer if he held the money in trust for the sister, to dole out when he felt there was need? How about keeping the money in trust for the sister's kids, who can't help that their parents are bad with money, but might like to buy cars, go to college, etc.?

I agree it would be a shame to see an inheritance blown on bullshit, but if the money could be directed at worthy needs....maybe paying off a mortgage to ensure the sibling's family has a place to live....I think I would be OK with that, as long as it was stipulated that the house wasn't going to be sold or used for home equity loans to go buy crack or blow in Vegas.

Keep in mind, that honoring the parents' wishes should be tantamount here.
