Default Florida judgements......expired??

I have a judgement against some crooked bastard who conveniently died just about the time my judgement 'expired' which is 20 years......it involves a business venture I was screwed in.......

so under Floriduh 'law' is there anything I can do to get it renewed?? and then maybe supported for payment from his estate, him having some 4-5 houses in the estate that has NOT been filed for probate yet......

Sounds like you need a lawyer if you are pursuing via real estate assets a judgment that is still outstanding, on a party that is deceased.

Did your lawyer who gained the judgment 20 years ago attach the judgment as lien to real estate owned by the defendant??

Lastly, it will help you if your lawyer refiled the judgment prior to its expiration.

You'll probably have to take your solace in gloating over his dead body the way Yaddie would.

One thing I'm an expert on is this:
At a 100K claim, Gene would be lucky to end up with 37k.

Fleece baggers will take a min. 33%, and perhaps more.

Go for it Gene, claim 200K.

Used an interwebby compounding calculator:

$37K
20 years
6.00% per annum for FL Judgments, your lawyer can advise on this

$119K is the amount your are legally owed

I asked Chat GPT (AI) and here is the response:

Quote:
I'm not a lawyer, but I can try to provide you with some general information. In Florida, a judgment is generally valid for 20 years from the date it was entered. If the individual against whom you obtained the judgment has passed away, you may still have options to enforce the judgment against their estate.

To pursue payment from the deceased person's estate, you typically need to initiate probate proceedings. Probate is the legal process through which a deceased person's assets are distributed to creditors and beneficiaries. If the estate has not been filed for probate yet, you may want to consult with an attorney who specializes in probate law in Florida to understand the process and your options.

Keep in mind that laws can vary, and it's essential to seek advice from a qualified attorney who can review the specific details of your case and provide guidance based on the most up-to-date laws and regulations. They can assess the viability of renewing the judgment and help you navigate the legal process involved in pursuing payment from the deceased person's estate.
