The security guard used excessive force.
If you are subduing someone until the police come or you can put them in cuffs and they die the chances are they have used excessive force.

The question isn`t whether the dead dude is an asshole, but was the security guard in a life threatening situation where he felt he had to use force.

Makes no difference. He should be allowed to use any and all force he damn well pleases. Commiting a crime is a choice. Stopping it is a duty.

Life is about choices.

If someone chooses to be bad, they have accepted every potential outcome and are ok with it. Otherwise, the choice would be different.

Back in the day, whenever we turned some scumbag over to the local constabulary, the only thing that would get you in hot water was beating the scumbag after we handcuffed them.

Right, but they didn't drag him behind the store and execute him. It wasn't street justice. I don't see much difference between this scenario and where the scumbag, while trying to flee the scene, runs in front of a moving vehicle.

The scumbag was apparently combative and died as a result of the response his actions made necessary.

Law breakers...takers, should not be given a pass to get away simply because there is a chance that detaining them, may kill them.

All the guy had to do was, walk in and NOT steal something....and he would be alive.

or

Steal something, and when busted..STOP, get to the ground, hands behind his head..and accept his punishment and due process.

His chosen path, however...got him dead.

Guard didnt use a gun, a knife, a taser, a night stick...it was mano a mano, and the theif came up short on mano.

Then I guess natural selection has chosen its course.

"Dumb" is not nearly as good a defense as "dead" is a deterrant.


Honestly, it's really is about choices. If you lack the intelligence to consider the ramifications, then you more than likely lack the intelligence to choose differently in the future and will repeat.

You guys are wrong on this, the shoplifter CHOSE to: 1) steal (crime), 2) resist detainment (crime) and 3)fight (crime)
his poor choices caused his death, had this criminal made a different decision anywhere along the way he would not be dead. Place the blame where it belongs- squarely on the person with poor decision making skills and no one else.
