UPDATE:

hoa lady called, said their inspector (contract company) generated the complaint, it was not a resident complaining. Discussed my position, we both agreed the issue needed a little more research, they are suspending further action until we have clarification of the state law.

Many HOAs hire a management company to hold contracts, pay invoices, get quotes for work, arrange meetings, and a long list of things. It's not uncommon. If the HOA desires the management company will do periodic inspections, but it's optional. Our HOA has a management company, but they don't send any warning/violation letter to a resident without approval from an officer or the entire Board - but we're a very small subdivision where everyone knows everyone and the HOA is very low key. HOAs are regulated far more in FL than any other state, even requiring training and certification for every Board member. Without a management company it's likely an HOA in FL would be in violation of state law.

The irony is not lost on me that the conflict is over me hoisting a flag that symbolizes the concept of wanting to just be left alone. Nevertheless, I believe in trying to not shit where I eat. If I can work it out amicably, I would prefer to go that route, vs. going scorched earth.

I'm OK generally with the hoa.......we all benefit from mowed yards, no junk cars in front yards, etc. I am also OK with the trade off of not being able to fly, say, a Trump flag, in exchange for not having blm or fag flags flying where I live.

The developer sets the restrictions
The management company sends letters and does drive-thru inspections, as well as billing of fees.

I'm tryin to figure out what the HOA actually does.

In our case, the management company serves as the lead on the architectural committee. They are responsible for reviewing all plans, from initial builds to modifications, against the architectural guidelines.

The HOA, per se, executes all business dealings with providers (electric, gas, wideband, snow removal, trash, etc., etc.), maintains our private roads, maintains our lodge, administers budgets and expenses, organizes many committees including landscaping, social, decorating, among others. Manages volunteer aspects, like snow stake installation and removal, meadow mowing, gate house maintenance and painting. They do a lot.

I'm curious: Is the neighborhood you live in fully developed or are there still lots left to be built out?

When I was HOA Prez, our Covenants had all sorts of verbiage about the developer's rights and so forth, but yet the last lot to be built on was completed 5 years prior. We had the covenants re-written by a lawyer to strip the developer of any authority. Our neighbor hood only had 300 homes, so it wasn't hard to do.

My section has been finished for 12 years, yet the developer still holds 2 lots, those two lots affords the developer 3 out of 5 seats.

There are other sections still under development but not mine, doesn't matter developer gets all the rights till all the lots are sold. When speaking with the elected board members they're generally okay with the consistent representation we get from the developer. It feels shady as shit to me, but he has a point, this at least prevents activist karens from getting a seat on the board for single issues.

I would be interested in putting up a bat house, a small one, and I have occasionally seen bats around, but wonder if that would have a deleterious effect on bees. I suspect the pollination that did occur was mostly from a few wasps that like to hang out in the area.
