Asked how Clinton’s apparent security lapse compared to the high-profile cases of former CIA director Gen. David Petraeus and former CIA director John Deutch, Rivkin said the gravity of Clinton’s situation is "orders of magnitude higher."

That’s significant given that Petraeus’s case led to a criminal prosecution. He pled guilty to mishandling classified information, a misdemeanor, and was sentenced to pay a $100,000 fine and serve two years of probation.

The FBI is expected to determine whether the server data can be recovered. Experts on data recovery say there is a strong likelihood that information from an erased server can be recovered, unless additional steps have been taken to eliminate the information. Highly skilled experts are said to be able to erase data without leaving evidence of their work.

Another wildcard in the burgeoning case is whether data on the Clinton server was subject to some form of backup storage — a routine precaution according to IT experts.

According to The New York Times, information from the Clinton server "was stored with a small technology company in Colorado called Platte River Networks."

According to the Times, Kendall, the Clinton’s attorney, informed federal investigators that "the server at Platte River Networks" had been wiped clean.

I can't stand the woman and hope she pays for her crimes, but this is hyperbole. David Petraeus INTENTIONALLY gave classified material to someone without clearance. Clinton, as far as we know, has never intentionally and directly given someone classified material.

That being said, she should at a minimum also be charged and at a minimum also forced to at least plead to a misdemeanor and fine. She damn well better not get off completely, and she damn well better not be allowed to waltz into the presidency.

But Steven Aftergood, who directs the Federation of American Scientists’ project on government secrecy, said Abedin’s potential access to secret materials could be a problem.
“What happens if [a former government employee] still retains access through a prior server, to information that was justified by a previous position? That’s not supposed to happen — and that’s one of the anomalies that are created by the private server,” Aftergood said.
Classified materials with national security implications are supposed to be stored in a place where no one can gain access to them unless they have special clearance.

We still don't know who she shared information with. Apparently others were also using her server and she was communicating about national security issues with people who did not have the proper clearance or need to know.

The REAL question should be who in the White House, NSA, CIA, DoD, FBI and other organizations she communicated with keep working with her on sensitive issues on her private server?

Anybody who has ever had a clearance can tell you that it is completely irrelevant.

Bringing classified material to a non-classified computer is just as bad. TS material on an UNCLASS system?? As said, if it was me, I'd be in Leavenworth without question. Do not pass Go. Do not collect $200.

The rules really aren't that complicated and there aren't many of them. Under no circumstances do you EVER put classified information on an unclassified computer/electronic device. Period.

She INTENTIONALLY broke that regulation. There is no other way to spin it.

The latest revelations about top secret information traversing Hillary Clinton's private email server have triggered accusations that someone in her "inner circle" likely stripped the classification markings, illegally.

The claims come after the Clinton campaign stuck to the argument that the Democratic presidential candidate, while secretary of state, never dealt with emails that were "marked" classified at the time.

"Hillary only used her personal account for unclassified email. No information in her emails was marked classified at the time she sent or received them," campaign Communications Director Jennifer Palmieri said in a statement to supporters Wednesday.

But a State Department official told Fox News that the intelligence community inspector general, who raised the most recent concerns about Clinton's emails, made clear that at least one of those messages contained information that only could have come from the intelligence community.

"If so, they would have had to come in with all the appropriate classification markings," the official said.

The official questioned whether someone, then, tampered with that message. "[S]omewhere between the point they came into the building and the time they reached HRC's server, someone would have had to strip the classification markings from that information before it was transmitted to HRC's personal email."

And just expects everyone to just believed her when she says she only deleted her personal emails.. with her history of always changing storys?? Yeah right!!!

I might be wrong, but don't think anyone would have cared if she also used the proper .gov secure email for some personal emails also.

..or at the least used her own private email for just personal messages.

Bottom line is... you can bet she also deleted some embarrassing classified discussions, but in time a lot of those can or will come out also if they look into it.

The Benghazi deal comes to mind right off..

But then again the powers that be may help cover her as they don't want that info out there either..

All they have to do is look and see who all she was sending emails, then compare what she turned in, verses what was shown on the other end of the recipients who used the right channels.

You can bet they didn't all delete theirs also..

It's obvious that HRC used the server to mask her activities so NO ONE could ever hold her actions as Sec State against her in her run for President. She was aided and enabled by way too many people within the government. This is bigger than HRC hiding stuff. It's poetical gamesmanship within the political elite with NO regard for national security or the laws of this country.
