The police didn't charge him with a crime. Doesn't the DA usually follow the same route as the police dept.? Which way does the DA lean in that county? Seems like there was one in another FL county a couple of years ago that was anti-police or anti-gun and there was a big story about them vs. local police.

The police can only arrest someone. It takes the DA to file formal charges. The DA and police will obviously work together as far as the investigation goes. But the decision to file charges lies with the DA. if the DA, who has to get elected to keep his/her job doesn't want the political flack from filing charges, a Grand Jury can be empaneled and they make the decision to indict. This is just the kind of case, being a political hot potato that could get turned over to a Grand Jury, and it wouldn't surprise me if that happened.


The Grand Jury works for the DA, and the DA is their legal counsel. They have subpoena power, and can compel people to testify under oath behind closed doors. Someone testifying before a Grand Jury can have counsel, but usually the counsel must remain outside the room while the witness testifies. The witness can leave the room and ask counsel questions whenever they feel the need to, even after every question that is asked.

I say all of the above with the caveat that that is how it works in my state, and most states, I think. I do not know the specifics of any Florida laws that may differ from what I wrote.

read a story just a few days ago, some b-ball coach punched a guy, and the guy died of the single punch.

so now he gets to convince a judge or jury that he was in fear for his life when the guy punched him.

or just avoid people altogether.

OK. We're all in agreement the dead guy should have kept his hands to himself. I also stated up-thread;

The question is this; Does pushing someone to the ground warrant deadly force? Sure. The guy who was pushed could have bashed his head on the ground and died. But he didn't. He had the wherewithal to pull a gun out, aim, and shoot the other individual.

I have a hunch this will end badly for the shooter.

Fact is even people who pass background checks can be idiots or power crazy.

there's no need to guess. Check any state that enacted CCW in the past 20 years; look at 5 years before CCW... and 5 years after, and see if shootings have:

*increased
*stayed the same
*decreased
