Comey plainly ruled: no indictment because it wasn't intentional.
But then threw away the part of investigative law that is used to determine intention or not. He found she did the things she was accused of, but wimped out with the sentencing (indictment) part of the process.

Sadly, the state of affairs of the USA is this bad at the moment.
