Do the appellate courts have any say-so over how a judge performs? I am not referring to bias so much as making bad rulings that get sent back down to be fixed. We have a district judge who is known among attorneys for often having rulings overturned and sent back to the district court to be redone. I am not referring to big cases, but things like landlord-tenant disputes where the judge did not make the ruling based on law, but rather some sort of "compromise".

I think she needs to better evaluate her likes and dislikes about practicing law. Her reasoning hardly accounts for abandoning years of preparation. She should be focusing on how to use her talents and education in a way that she finds rewarding be it with your law firm or without. I would encourage her to branch out rather than give up. I assume there is alot of variability within the profession.

Maybe she is just tired of her dad stumbling out of his office naked at 10am smelling of alcohol yelling something about a bag of d$&@s.

Awww, she's used to my behavior!

Variability in the profession is hard to define. Typically the major distinction is trial lawyers and, for lack of a better term, desk lawyers. And in this age of specialization, there are as many fields of law as there are categories of law. But the bottom line is that all lawyers have to learn to practice law, not just through education.

Appellate Courts very much have a say-so in how Judges perform. Appeals Judges don't like the tedium of constantly having to reverse a Judge who makes dumb rulings. Almost all lower Court Judges try to scrupulously follow the law for fear of getting reversed; they view it as sort of a reprimand.

A Judge who gets reversed a lot can be disciplined or removed from the Bench. The Federal Courts are very strict about this. A local Bankruptcy Judge wasn't in his office at 3:00 p.m. one Friday, and the 5th Circuit removed him.

I find the idea of her stumbling around and just happening to chose your career path - with no external influence - highly unlikely. Getting a law degree and passing the bar requires dedication not usually associated with just a casual interest.

Perhaps now that she has achieved your dream, she has realized that it isn't hers.

Or maybe she just doesn't want to work for you.

Either way, you won't win forcing the issue. She will either be miserable and hate you for it, or tell you to pound sand.

Cut her off and sell the house. Let her sink or swim on her own. What ever then happens, it will at least be her decision.

I'll take issue with only one thing in your post: External influence. If by that you mean me, you are mistaken. My standard comeback to the question from my friends when she was in college, "What does she plan to study?", was, "I don't know...except not a lawyer!".

I stayed out of influencing her career path; that's a no-win situation. She studied psychology in college. In January of her last year of college, she announced that she was going to law school. About floored me.

I don't plan to immediately foreclose on her house. If she somehow makes the payments, that's fine with me. I think it would be overkill and cruel to foreclose without her defaulting. She gets no money from me for her other bills.

I certainly have on many occasions. Daughter has a dis-trustful relationship with mom cause mom can't hold things in confidence. My discussions with her have produced almost no results other than an affirmation that we still love each other.
