Default Texas allowed to arrest illegals

https://www.texastribune.org/2024/03...er%20illegally.

The 5th U.S. Circuit Court of Appeals late Saturday reversed a lower court’s ruling that halted a new state law allowing Texas police to arrest people suspected of crossing the Texas-Mexico border illegally.

Every single PD needs to be jailing every single illegal alien driver caught. That would take dangerous drivers off the roadways, the kind that are drunk, unqualified, and don't carry insurance. I doubt most departments will have the intestinal fortitude to do that, though.

~arrest every illegal encountered

~hold with no bail due to flight risk/no ties to the community/danger to the community

~if their only crimes are illegal entry, no DL, and whatever the traffic crime was, speeding, light out, etc., then offer them the choice to get out of jail on their terms. Agree to self deport, agree that if caught here again, they do a mandatory stint in jail. Or sit in jail until a judge can hear their case. Then put their cases at the bottom of the pile.

Had Texas been able to do this two years ago, Laken Riley and many others would be alive today.

And impound and crush their jalopies.

Taking away their licenses doesn't stop them from driving, but taking away their wheels definitely would.

And put 30 of them per cell until there are only 5 left alive. Send the 5 back where they came from.

I think that the invaders/border jumpers should be executed. Hang their rotting corpses on the fence/wall as a stark reminder.

Both of these would be clear violations of the 8th Amendment prohibition on cruel and unusual punishment. If we take cars because their illegals, why not start seizing cars from people with burnt out tail lights, or who got caught going 11 over? It's not the government's car. The government didn't pay for it, the illegal alien did. Let them take the car with them when they cross the border to Mexico, or sell it here for cash.

What if the illegal has a gun. Should he/she be allowed to keep it under the same argument?

If you are caught in a criminal act you will have the car confiscated. TFB

Yes, I think so. I'm not even that fond of keeping guns away from ex felons that have completed their sentences. Keeping guns away from people on probation or parole? Yes, OK, they're giving up certain rights in exchange for not being in jail or prison. For anyone NOT encumbered by probation or parole, I'd think gun ownership is a God given, basic human right, period, a right further enshrined in our Constitution.

It's a slippery slope...start creating more and more reasons to grab guns, and sooner or later YOU will find yourself on one of those lists. Always error on the side of individual freedom v. the State.

So I guess you're also against impounding the cars of the shitstains who participate in sideshows and takeovers?

I'm not against arresting the drivers and towing the cars, but I am against STEALING the cars. Who paid for the car? Not the government.

So these street takeover idiots, if caught, will have criminal charges, bail, have to pay for a lawyer, have to pay to get the cars out of the tow lot. The punishment should be whatever the sentence/fine is for that crime. Stealing the cars outright? Yeah, that's gonna be a no from me, dawg.

Unless you can show me the car was purchased with money from a bank robbery, i.e. stolen funds, then no, I don't agree with taking away someone's car. 8th Amendment problems.

Irrelevant. All kinds of property involved in the commission of a crime is subject to forfeiture. Think RICO.

A lot of hunting/game laws are very stiff. Depending on circumstances you can get your gun, the animals, many times the vehicle confiscated!

Your garage, barn, shed or other out building searched+ your ass could go to jail!

You think far too highly of the enemy and if you don't see the invaders as the enemy, you think too highly of the invaders. Our laws and rights are ours. The rules need not apply to the invaders. They are no different than the guy that sneaks in your window at night. You get to be the judge, jury, and executioner and as a side benefit, save taxpayers court costs.

That's the same bullshit being done to Trump right now, today. In fact, it's the same thing we have discovered all the Get Trump players are doing TO Trump. Jack Smith, Garland, Homegirl Letitia, Homeboy Wade and his sugar mama Fani.....all of them conspired to **** over Trump. Maybe we need to RICO THEIR asses and steal all their stuff?

Payback sounds great, but again, slippery slope. The RICO law is being used as a cudgel, a blunt instrument, and as it's being currently used, it's an affront to the constitutional protections enshrined in the Constitution.

Expropriating private property is banana republic shit, and shouldn't be tolerated or even considered here in the US, no matter how bad you hate someone and want to see them suffer.

YMMV

I've seen that, and that is also wrong. If there's a fine for taking game illegally, OK, that's what it is, pay the fine, or if there's some kind of jail time, like for killing an endangered species, again, OK. Stealing people' stuff, though, that's just not OK. Because if we're OK with stealing THAT guy's stuff, why not YOUR stuff. Did you use your turn signal 100' from making your turn? Is your tail light or headlight burned out? Get out. That's OUR car now.

I once was fishing, and was doing it the old fashioned way, cast netting for bait to have in the bait bucket. The area was a "shrimp sanctuary," meaning, you're not allowed to take any shrimp from that area. I got stopped by the game warden one evening, a quick look in the bait bucket revealed some shad....and one lonely shrimp. Warden suggested I let the shrimp go and he would move on, which I did, and he did. Maybe he should have seized my fishing equipment, for my grave crime? Seized my car, even though I walked from my apartment to the water? Should he seize my car and my truck, since I owned more than one car? How about seizing my company car as well?

That's patently unfair, which is why we prohibit cruel and unusual punishment.

This is not as black and white as you are making it. I don't think anyone would agree with seizing a vehicle for a light being out. No court would (should) support that. This is where INTENT comes in. There is a HUGE difference between something done inadvertently and something done will ill intent and the punishment should also be different.

If I'm aiming for a duck and kill a Bald Eagle, I deserve a fine. If I am aiming for a bald eagle, that's very different.

Punishment is not JUST a penalty. It is also a deterrent. Understanding that you could lose your arm if you steal, means that when you steal AND you lose your arm, you should not be the least bit shocked.

We're far too soft on crime. Extreme penalties for SERIOUS crimes should be enforced. A burned out bulb is not a serious crime. Invading a nation is.
