Though by your math as well, the 12pk pretty much isn't drinking. When he gets arrested you make the case that a 12pk of beer isn't drinking.

I used to be a semi pro drinker when I was a Marine. Once I had a wisdom tooth pulled and they gave me percoset, I took one of those and drank a fifth of Segrams 7 and didnt die. I figured I wouldnt get any better than that so I stopped trying to drink the whole world. felt just fine when I woke up the next morning too. Aside from the scabs on my cheek and my swollen eye. Apparently I fell down, my GF was really pissed too.

After the last month, with the house flooding, family members being complete dumbasses on a level I've never seen before, friends being diagnosed with cancer, etc., my wife and I are considering taking up drinking as a full time occupation. There's only so much more we can take at this point.
