I don't care if he hit the throttle and pulled the front wheels off the ground, if he did, it was with the reasonable assumption that the kid was going to stop at some point... like every other driver who has gotten out of a car has done... rather than to keep coming to the point that he got hit. There is absolutely no way that he could have reasonably expected the dumbass to keep coming down the track and run into the car.

Most people are smart enough to realize that no matter how pissed you might be and no matter what gesture you want to make, you don't do it by jumping into the path of a race car.

The absolute dumbest part of the whole thing is that the wreck wasn't even Stewart's fault.

I hate to blame a dead guy, but this kid was a straight up f**king idiot that made an idiots decision that got him killed. I'm not a Tony Stewart fan, but this is absolutely stupid.

To assume he "was going to stop at some point" accepts that Stewart saw the kid. If Stewart saw the kid and did ANYTHING other than attempt to stop or turn away from him, he will be found to be culpably negligent. Bet on it.

Not if I was on the jury.

If you are driving down the highway and see a person walking on the shoulder do you slam on the brakes? No. You assume that they are smart enough not to walk into oncoming traffic. If you are driving through an intersection when you have a green light, do you swerve and slam the brakes... just in case the person sitting at the red light decides to pull into the intersection? No, you don't... because it can be REASONABLY assumed that they are not going to take off through the intersection. There is absolutely no reason that Tony Stewart should have ever expected that he would do what he did. It's not as if he was standing still and Tony drove right at him and ran him over. The f**king dipshit ran HIMSELF into the side of the car.

The dumbass ran into oncoming traffic on a race track. It is his fault and his fault alone that he is dead.

With no evidence of an intentional act by Stewart, I would agree with you. Blipping the throttle is going to get charges against him and likely a conviction.

It's called pass the buck..The state attorney can only win on this one. If no indictment then tony has no worries criminally only civilly. If he does not send it to the grand jury then he will be criticized for not doing anything. This takes the heat off them. Now he can say he tried and the grand jury returned no indictment. Unfortunately this is what it has come down too throw shit against the wall and see if anything sticks. If I was Tony I would sue the family and the track where it happened due to the mental anguishment and trauma that it has caused due to the other drivers negligence.

That ten feet was covered in less than a second. The way those cars are set up the driver uses the throttle to help steer the car. If you notice the rear of the car veers left, and yet it still struck Ward with the rear tire and pulled him under. If the front of the car had hit him Ward would have went over the front. If he went under the front I would think the front on the car would have reacted upwards and it didn't appear to. I think he stepped into the rear tire.
