To assume he "was going to stop at some point" accepts that Stewart saw the kid. If Stewart saw the kid and did ANYTHING other than attempt to stop or turn away from him, he will be found to be culpably negligent. Bet on it.

With no evidence of an intentional act by Stewart, I would agree with you. Blipping the throttle is going to get charges against him and likely a conviction.

It's called pass the buck..The state attorney can only win on this one. If no indictment then tony has no worries criminally only civilly. If he does not send it to the grand jury then he will be criticized for not doing anything. This takes the heat off them. Now he can say he tried and the grand jury returned no indictment. Unfortunately this is what it has come down too throw shit against the wall and see if anything sticks. If I was Tony I would sue the family and the track where it happened due to the mental anguishment and trauma that it has caused due to the other drivers negligence.

That ten feet was covered in less than a second. The way those cars are set up the driver uses the throttle to help steer the car. If you notice the rear of the car veers left, and yet it still struck Ward with the rear tire and pulled him under. If the front of the car had hit him Ward would have went over the front. If he went under the front I would think the front on the car would have reacted upwards and it didn't appear to. I think he stepped into the rear tire.
