If I see anyone anywhere on my property - I will approach them and calmly ask who they are - and what they're doing. I do this even if they are wearing uniforms & hardhats. Get close enough to asses the situation.

If the workers walk on private property to reach an easement... they are trespassing. There's no legal get-around on that. This is why they are required to ask permission when using this shortcut method.

Also, if they enter the easement legally (no matter how far away the entrance of the easement is - in relation to where they need to perform the work)... and then stay within the boundries of the easement at all times... they don't need to knock on door; and probably won't. No permission is needed. But even then - you still should go to where they are and get a feel for what they are doing.

None of these easement encroachment issues would exist if the government hadn't stole the easements from the developer. As I noted in post #21.

I realize things are a little different when we are talking about a house in a subdivision, and a guy walks up with no trucks or equipment visible, but I always get a laugh when a landowner challenges one of our crews. When we roll up, we've got either tractors and mowers, a tree mulcher, a jaraffe, or some combo.

"What are you doing here?"

Must resist the urge to say something smart ass, like, we are Al-Quaeda rebels, and we are here to bring down the country by mowing the pipeline easement that runs through your property. If you had kept that easement cleared, you could have saved the country, but since you didn't we are here to kill you.

WTF do you think we are here to do with that kind of equipment?

You want electric service from the local electric utility? OK, in order to have that service, you have to agree to allow the utility to access your property, unless you choose to have your meter placed on the edge of your property, rather than mounted to the side of your house like most every one I have ever seen is. And that's probably no problem if you want to custom build, but then if there is a problem with your drop (the wires you own coming from the meter to the house), it's all your problem. Oh, I totally agree that they have a right to know what you are doing there. Our guys are always polite and forthcoming about what they are doing and why they are there. I guess not. What difference does it make who actually "owns" the easement. The homeowner still owns the land, and still must suffer with people associated with whatever utility needing access to that easement.

What difference does it make to the homeowner whether the developer has been cut out of residual income or not?

Here's a little mind blower for you guys.

Say utility workers are on the easement. They have to trespass on your property off-easement to go to your house/barn/wherever you are to notify you that they are there and what they are doing. In many cases that means they are approaching from the BACK of the property, not up the driveway from the street. To give you the respect you deserve, they have to violate your private property rights.

Common sense solves most of these issues.

Utility companies used to access the "easement" through a paved alley. No need to access the owners property unless there is a problem with the drop.
A meter reader is a different issue. My pops house used to have the meter inside in the basement. On meter read day, we'd leave the basement door open so the reader could come inside to read it.

Let me tell you this; you trespass on my property; you will see me face-to-face, and I have zero hesitation to call the police. This will stop your workday - dead in its tracks; it will turn out to be a zero production day for you and your crew.

Don't want this hassle ? It's this simple; If you want to have a work day go smoothly & flawless... don't ridicule private propertry owners. Show proper respect by knocking and obtaining permission before going outside any easement path.

Actually, the utility company (power company) owns the poles. And correct, the utility co. leases access to the other providers (cable and tele)
