Default So I rear ended some lady before Christmas

Pulling onto busy frontage road. African lady (from Kenya) in front of me. I see her go and I immediately look to my left to see oncoming traffic while I slowly lift my foot off the brake and creep forward. Doink.

After I turned my head, she had second thoughts and jammed on her brakes. In my mind, she was gone. (She had scads of room to go) so I was creeping up to take her place at the ready.

So I just tapped her cheap KIA or whatever van. No tickets issued. Cop took report. (He asked if the damage to my front end was caused by the accident. I laughed and said "I think the accident might have actually realigned some stuff from when a semi threw a chunk of rubber into my front end...)

I was supposed to call my agent. I have not. I've also heard nuthin'.

What happens if I don't call?

Do you want your insurance agent to hear your side of the story or hers first? I would imagine if you exchanged insurance info, your insurance company will be hearing from hers. It's happened to my wife, it's no big deal, it's why you have insurance.

I will call them. Just keep forgetting. Haven't been myself lately. Brain overwhelmed, vacation mind. Virus last week has aggravated my disease. Apparently The Norovirus actually alters the cells in your digestive tract on a genetic level. For people with Crohns Disease that could not be worse.

Probably end up back on the nasty chemo.

Yea if it was me I would just at least let my insurance company know about it , and since you rear ended person it will probably be your fault , just my 2 cents , good luck and let us know what happens

What happens if I don't call?
You need to report that accident, ASAP. That woman already has a lawyer and probably a dozen doctor/chiro visits into her claim already, and counting. Nonspecific neck and lower back pain. Missed work. She may even have permanent impairment and disability from the wreck.

You have a contractual duty to inform your insurer about the accident, to notify them of their liability. If you don't, they could conceivably deny the claim, leaving you on the hook for the resulting lawsuit against you.

I'd get out ahead of this thing and call your agent first thing tomorrow.

Oh, and one more thing. Her husband was the one that taped the flyer to your door.

The only reason to contact your agent is if she suddenly has a car in the shop with $3000.00 damage and claims you did it.

I have called, and I have not called. If she wants to collect, they already know about it. If she doesn't, let sleeping dogs lie. Odds are the police have some indication of the damage. Reports for accidents I have been in have all stated minor damage or something to that effect.

If it were me, I'd do nothing...but that's me.

Same thing happened to me years ago. An old guy decided to change his mind and wait for a car that was a block away. I saw him go, looked left (I was turning right), and it was all clear, and BAM right into his ass end. Cost me 400$.....damned old geezer!

People here drive like dawg shit, and it's getting worse all the time, more burbs being built to the point it's sublime already......anymore traffic down here is almost as bad as DC......I blame all that hesitation crap on TEXTING, they looking/distracted by that magic acreen, and I guess it's better than reality.....

The damage looks minor, but I am sure they will replace the entire panel ... very few shops actually do actual body work.

Snake owes LKQ....like kind and quality, which means r&r with a used Toyota panel, not a bondo job.

7 days rental car: $ 300

injury: $ 3,200 in specials
$ 5,000 in p&s

lost time from work: $ 1,300

Total claim: $ 11,250.

That's assuming she doesn't pursue a diminished value claim, since the car has now been wrecked, and isn't worth as much as it would be if it hadn't been in an accident. No more clean Carfax.

This isn't the lawyer in me coming out, but I want to tell you a true story: I defended a guy who slowly let his car roll into the rear end of another car. Very little damage to his or the other car.

My guy heard nothing about the accident for over a year...then he was sued for over $300,000. I called his lawyer, a personable, honest guy and told him that this all looked suspicious. He said, "I know it does, but my guy had foot problems before the accident. When his car got hit, he reflexively braced himself with his feet on the floorboard. That set off his foot condition, and he was off work for 8 months and has medical bills of about $75,000." He had doctor and hospital records and bill to prove it.

Unusual, I know, but it can happen.

What did that settle for? I'm assuming your client's insurer denied based on non reporting?

my sons BMW i think i made a thread about it, was hit while parked yes minor damage but once the colision personnel looked into the bottom of car which should have been a panel, ended needing the car being totalled
