Texas gunman Devin Patrick Kelley shouldn't have been able to buy gun - Business Insider

The federal government's firearm transaction record, which buyers must legally fill out, asks about felony convictions. Kelley bought a Ruger AR-556 rifle, used in the attack on the church in Sutherland Springs, Texas, in April of last year from an Academy Sports & Outdoors store in San Antonio, a law-enforcement official told CNN.

The purchase of the gun took place two years after Kelley had been court-martialed, imprisoned, and discharged from the military.

That gun store is in deep crap unless he lied on the form and it was not picked up in the background check.

Even if he lied, the background check SHOULD have picked it up. Maybe the store knew, but sold the weapon anyway, to enrich themselves.

Either way, bad times are coming their way.

If you take a general hatred, toss in a little low self-esteem and perhaps some mental issues, we will continue to have this but on a much higher frequency.

This isn't some little gun shop. Several exist in San Antonio.

i know when i go to my local gun shop to buy a gun, i fill out the 4473 truthfully, they then call it in or do an online check (this is new and way faster), they get an "approved" as well as a confirmation number for that check and that is written down on the form. then a second clerk verifies the form is properly completed, and only then do i get my gun.

assuming Academy went thru similar actions, there was a screw up somewhere.

Academy is a HUGE retail chain down here. Think Walmart for outdoors and such. I'd be curious as to where/how the breakdown occurred.

The latest motive scenerio is that he was targeting his ex MIL. Had made (unspecified) threats against her recently. And she was not in attendance at that service.

Hey mods: small pick.....I definitely did not choose a smiley face for this post, rather, a frowny face. I don't know how the smiley face got there, but if we could get rid of that, it would be appreciated.

Texas church shooter reportedly fractured stepson's skull on purpose | Fox News

bad conduct, not dishonorable discharge. therefore, not barred from having a firearm.

That does not mean he was arrested for a felony or it would have showed up in the ATF background check. Most domestic violence arrests are misdemeanors unless its an agg battery..

11.i - "Have you ever been convicted in any court of a misdemeanor crime of domestic violence? (see Instructions for Question 11.i)

i suspect that most misdemeanor crimes are not listed in a database, so they would not flag on the background check.

Instructions ....

Question 11.i. Misdemeanor Crime of Domestic Violence: A Federal, State, local, or tribal offense that is a misdemeanor under Federal, State, or tribal law and has, as an element, the use or attempted use of physical force, or the threatened use of a deadly weapon, committed by a current or former spouse, parent, or guardian of the victim, by a person with whom the victim shares a child in common, by a person who is cohabitating with, or has cohabited with the victim as a spouse, parent, or guardian, or by a person similarly situated to a spouse, parent, or guardian of the victim. The term includes all misdemeanors that have as an element the use or attempted use of physical force or the threatened use of a deadly weapon (e.g., assault and battery), if the offense is committed by one of the defined parties. (See Exception to 11.b. - 12.) A person who has been convicted of a misdemeanor crime of domestic violence also is not prohibited unless: (1) the person was represented by a lawyer or gave up the right to a lawyer; or (2) if the person was entitled to a jury, was tried by a jury, or gave up the right to a jury trial. Persons subject to this exception should answer "no" to 11.i.

rant time:

liberals call for congress to "do something", but then either don't offer what that something might be, or recycle things we know won't change anyone's actions in the future.

so, here's an idea for doing something: the military just agreed to buy new pistols from Sig, the M17 in 9mm for a reported cost of $207 each. includes 2 mags and a holster.

you can buy 9mm ball ammo for about $200/1000 rounds, and 9mm JHP ammo for about $50/50 rounds.

i bet if you asked, plenty of NRA members would offer to show you how to use the above safely for little or no cost.

so arm responsible people in houses or worship. would cost less than $500/person.

in a small church, 1 or 2 people would be sufficient to deter and repel attacks.

done.
