Cliffs: Woman has argument with McDonalds about payment for extra cheese on a sandwich. Woman leaves restaurant, a refund issued. McDonald's calls police. Police tell woman she's being given a trespassing order, she agrees to leave, tries to leave, but they won't let her leave without giving ID. So they argue, then start manhandling her, she then gives her name, but by that time, they're intent on arresting her, as they beat her, take her to the ground and cuff her.

Problem: If you are being trespassed, you're supposed to be given a chance to leave without ID, then if you stay or come back, THEN you can be arrested. This woman was blocked in, not given a chance to leave. Clear 4th and 5th Amendment violations.

Observation: Lady seems like a miserable Karen. Still, they should have just let her leave. Take a picture of her and attach it to the trespass warning copy, so McDonald's can then have her arrested if she comes back.

I'm guessing she's gonna get paid for this.

While I agree with the overall sentiment, being a douchebag isn't a crime, and the cops violated her rights. They should figure out how NOT to fall into this trap. She probably was a douchebag to the McDonald's workers, we don't have that tape, but she waited for the cops outside, explained "her side" indicated that they gave her a refund and that she was leaving.

They were called to make sure the woman left. All they had to do was watch her drive off.

I've never had one refuse to show ID.
We don't get the report. Police have it in their system.

Taking a picture is bullshit. R Kelly was caught on video having sex with an underage girl, and urinating in her face. At his trial, the jury was shown the video, complete with tattoos on his back that matched the guy in the video, and he was still acquitted. The jury said there was "no way to be sure" R Kelly was the guy in the video.

My understanding of it, admittedly from mostly watching online videos, is that when you misbehave at a private business to the point where the cops get called, and the cops don't see evidence of any serious crime, but likely something minor like "disorderly conduct", they will ask the proprietor of the business if they will accept a "trespassing complaint" in lieu of trying to charge the would-be customer of anything. If the business owner accepts, and the bad-actor also consents, the bad-actor has to surrender ID, the complaint is filed, and the bad actor walks free without so much as a citation on his record. If the business owner sees him on the premises again, he calls the cops. If the cops determine he is the subject of a prior trespassing complaint, the cops charge him with criminal trespass pursuant to the previous complaint.

Sounds reasonable. I'll have to take your word for it. Personally, I have never behaved so badly at an establishment that I was asked to leave.
