Good question. I haven't seen the police report and I decided to stay away and let the cop handle it instead of throttling him. As you can see by the dash cam pic, he is at fault.

Your honor, we find the plaintiff's case to be entirely without merit. The plaintiff's vehicle is a 2017 model year. Clearly, based on the dash camera evidence, this accident never happened. My client cannot reasonably be held responsible for an accident involving a car that wouldn't exist for another two and a half years.

It never ceases to amaze me how limited in sight some drivers are. There is obviously a slow down directly ahead of them and they have to get in front of as many people as they can.

I usually end up passing them back while on cruise control a few miles past the slow down.

What kind of bullshit is that? Of course they determine fault. When they pull you over for 70 in a 60 they have no problem determining fault and writing a ticket.

Personally, I'm OK if a cop doesn't want to actually issue a ticket for a wreck, as long as the driver responsible has insurance, everything else is OK (no DWI, etc.), no one got hurt, and the driver expresses suitable contrition for causing the accident. Adding a ticket could be seen as just adding misery to someone who already is having a bad day.

Having said that, the cop was sent to investigate, and the fact he refused to look at your dash cam footage is disconcerting. Have you contacted the other driver's insurer? If they immediately accept fault, then all this is moot. If not, I'd be making a complaint to the PD that their officer failed to do his job. Meet with a supervisor to show him your dash cam video.

Fun fact: Sea Six was sometimes known to grill suspects for hours on end, in a hot interview room while the suspect sat on an unlevel chair and was not permitted to use the bathroom. In the end, though, he always got a full confession.
