Default Workers Comp?

Anyone ever had a WC case?


They have paid for everything, my treatments, my surgery etc. as there was no doubt this was directly related to workplace trauma.


They are closing the case and making final offer, get attorney or just let em' cut a check?

If your expenses have been covered so far, I wouldn't sign anything absolving them of any future costs. Although a huge amount of $$ might affect that decision...

I had a friend in college who had a back injury resulting from a car crash a few years earlier. The at-fault guy's insurance covered his expenses, but their family lawyer advised them against accepting any further payment accompanied by a release. During the time that I knew him, that decision had already paid off.

Yes industrial accident in 1977, fell 20' off a tank in a chemical plant.

Got busted up pretty good. Three weeks in hospital. WC picked up all the medical bills and basically the money I got was about what my wages would have been if still working. Had it to do over again I would have got a good compensation lawyer. A couple years later a another person got hurt similar to my injuries and he got what I got and about a 1/4 million in pain and suffering because he sued!

I was out of work about 4 months but was able to go back to construction work. I worked out of a hiring hall union..I took early retirement in 2002.

My friend (also in my union) that sued could never get a job out of the union as no plant or company would hire him. He changed occupations.

I don't have any personal experience with WC, but I do have experience "negotiating" with insurance companies on other things. Having made that disclaimer, here is what I think....

Are you sure you have done all that needed to be done in relation to your claim? If you are, the first you could do is just wait for their "final offer" and if it is huge and illogical, then maybe consider settling.

If it isn't, don't settle. Just tell them no thank you, not ready to settle. Don't bring up lawyers, lawsuits, courts, etc. They hear that everyday and know what it costs to hire a lawyer and sue them so they might consider it a bluff. They laugh at bluffs. What they don't laugh at is having to wait for your answer and having that file sitting on their desk. You are in control at that point and they know and hate it. The claim is still there and open.

I have gotten my number and sometimes more a few times by just waiting.

No doubt. I have had the surgery and treatments and they called to "close the case".

They offered "$XXXXX", I simply asked if I accepted that amount, any future problems I might experience related to my injury would not be covered right?

Immediately after my friendly question, the "offer" amount jumped up significantly.

I felt like I was negotiating for a freaking car purchase.

Will consult with OT before making my final decision.

It all depends on your situation. If you think you will have problems down the road, I definitely wouldn't settle. If you think you will be ok, by all means take the money, but just make sure it is worth all the misery you have put up with. So, I've been no help. You're welcome!

Guess it depends on if you think long term damage as a result of issue and or loss of income.
Me I'd probably take a settlement now as I bet the flood of claims and chance of laws being passed limiting liability will be coming.
