The way to challenge an unjust law is through the courts and legislature, not by contributing to a black market and then deciding you don't like the consequences of doing so when they are visited upon you.

I tend to agree with you that the legislature is using the tax a s a findraiser because they won't face a backlash for taxing unpopular things like cigarrettes, but it is far from the first piece of legislation that was put in place because it was politically convenient and only affects a numeric minotiry of their constituency.
