Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside."

you could argue that that covers alcohol, as it is a controlled substance, and regulated by the ATF.

You could argue that but you'd be wrong. Alcohol is not regulated under the Controlled Substances Act. It's regulated, but it's not controlled. Two very different things.

Technically, it is TTB that taxes the crap out of it. ATF just gets involved when TTB alerts them to problems. The two agencies used to be tied at the hip, but broke apart slightly during the early to mid 2000's.
