I’m pretty sure that if the HOA successfully took over ownership of the road it includes the entire ROW. And is now entirely responsible for the maintenance and liability of the ROW.

That's not the way it works here. The ROW was deeded to the county in 1974. That HOA can place all the pavement that they want on it, but they do so on land that they don't own.

As I posted earlier, odd.
So the county continues ownership of the ROW and the HOA assumes responsibility for the paved portion. Actually the pavement only, since the HOA doesn’t own the dirt below it.
Sweet deal for the county.

That's why I would never buy a lot there. That, and the cost. In 2004 I bought my lot with water and sewer access for $41k. Two years later that developer had lots listed ay $199k, with a promise of water and sewer that he delivered to about 5% of the development.

Between him and the grading contractor, they ripped off a lot of people.

Ever try to site a well and septic on a 0.45 acre lot? Next to other 0.45 acre lots? People have had to share wells, buy an additional lot- all kinds of bullshit. Then pay County taxes, town taxes, and big HOA dues.
