Default Atlanta Cop Who Shot Suspect Charged with Felony Murder

I think the message is clear. If you're a cop, and you want to arrest someone, just ask them if they are OK with being arrested. If they aren't, then you just let them go, because using any kind of force to insist that they be arrested is going to result in criminal charges for you, the cop. WTF?


My own personal take on the situation:

After the fight, after the taser was shot at the cop, yeah, shoot that ****er.

What could have gone differently:

Since the guy was on private property and cooperative, instead of arresting him for DWI, let him call someone to come get him, or call an Uber. Confiscate the car keys and let the driver pick them up at the station the next day. If the cops wanted to go a little further, have the car towed, to make sure the guy wouldn't drive it that night, let him pay to get it out of impound. His charge, right up until the fight, if there needed to be one, should have been public intoxication, but considering he was polite and cooperative, I would have let that go, in favor of just making sure the guy got home safe and didn't drive the car any more that night.

And yes, I'm fully aware he was driving drunk to get to the drive through.

The interesting thing is that I don't recall EVER seeing an officer allow a suspected drunk, to operate their vehicle after the initial encounter. They let him move his car, which struck me as very unusual.

I agree. He was supposedly .108, which, for anyone who drinks on a regular basis, isn't necessarily sloppy drunk. Based on them letting him move his car, I don't see why they felt the need to arrest him at all. I wouldn't have arrested him, I would have just made sure he didn't drive anymore that night and had a safe ride home. I have friends who have had that very situation happen to them in the past.

When my BIL was staying with us, he went out one night and got drunk. He did get pulled over, and his car was impounded. No idea how he got back to the house, but he was very sheepish in the morning. He had no idea which department impounded his car, so we had to call a number of towns to find it. He got lucky that night, as it could have been, should have been, a DUI.

I am not familiar with the DUI laws in Georgia. In California, if you are sitting in the car and have the keys in your possession, and you are drunk, even in your own driveway, you can be found guilty of DUI. The law has wording to do with being in control of the vehicle. It does not have to be moving. Sitting in it with the keys is considered "control". So here, I think he could have been and probably would have been arrested, considering he was in a drive-thru lane at Wendy's

What the cop has to consider is if he just lets the guy walk home to his sister's house, and he gets in his sister's car an hour later and kills someone in an accident, that cop is ****ed.

I don't know how often that gets enforced that way, but if you are going to sleep it off in the parking lot at the bar, leave your keys with the bartender.

I think Texas has something similar, which, IMHO, is a mistake. Let's say dude is driving drunk, then says, "Shit, I really shouldn't be driving, so he pulls over into a highway rest stop or parking lot to sleep it off. Yes, dude no doubt drove drunk just to get to that rest stop or parking lot, but if we make it a crime to sleep it off in that rest stop or parking lot, then what kind of incentive does anyone have to actually do the right thing and stop? Better to keep going and take a chance of making it safely to your house, vs. being exposed potentially all night to DWI charges for sitting or sleeping in your car off the roadway

As soon as that dummy shot the taser at the cop, all bets were off. I doubt they even get a conviction for manslaughter. They are just trying to appease BLM, and this poor cop is the scapegoat.

How will they ever find 12 impartial people to be on any of these juries? Unless you convict every one of them there will be more riots and the jurors who voted to acquit will have their lives ruined.

The fact that he was out on probation and couldn't have the arrest without serving the rest of his sentence was his motivating factor to fight and run.

He chose poorly. Many times.
