Extremely weak.

While the notion of copyright infringement arising from the unauthorized duplication of text has some merit, usually it will have to be from a book or other source that is otherwise only publicly available by purchase.

Since this article was 100% free for anyone to read on the LVR-J website, they will have a very difficult time proving damages resulting from misrepresentation of original author (not present), and misuse of copyright-protected text (also not present).

It may technically be an unauthorized duplication, but that's only one of three parts that will be needed to collect $ on an infringement suit. There is no question who the original author is, and there is no intent to profit from it's misuse.

If LVRJ intends to collect a $75k judgment, basically that is what they will need to prove, how they lost $75k solely because of that text's appearance on CF.

Good luck accomplishing that.

Worst-case scenario is CF will be asked to remove the post.
What will be interesting is what new rules CF dreams up to address this issue, sure could put a damper on the OT news feed.

This will probably neuter the PRC forum now... which sucks.

The LVR-J will have a heck of a time proving damages.... I mean IB can just figure out how many hits the received from the CF link. The going rate for referral clicks and bill them for "services rendered"

I think the fair use clause in Copyright law will have this suit tossed in a hurry. The fact that it was attributed and linked says there was no intent to steal the content and profit from it.

I think this is probably similar to the law firms that try to initiate class action suits hoping for a split of the pretrial settlement. They float these suits hoping that a few of them will amount to something. There was a firm Weisberg et al out of NY that was notorious for this and ended up getting hammered legally and disolving after some hefty fines.

I thought that if it's on the internet it belongs to anybody and besides it wasn't as if anyone was taking credit for it, if anything it was giving the article more exposure. Some people seriously have to get a life and worry about things that really matter.

As much as I dislike the people who run the CF (a couple of mods and 1 admin) I don't think it has anything to do with IB.
