That's true. Having said that, if I was Yaddie, I'd countersue for infliction of emotional distress, for loss of use of the driveway while the busted up car is stuck there, for damage to the driveway, and anything else I could think of. Loss of consortium? Yes, countersue for that, too. Yaddie had the Barry White on and was about to get lucky when the accident occurred, and the crash sounds spoiled the mood.
