Are you saying that the window does not drop slightly when opening the door and then the window being fully up prevents the door from closing?
If that's the case, you might try disconnecting the battery for a few minutes and then reconnecting it and reindexing the windows. Kinda like rebooting the system.
I had a problem with the touch pad on my '06 that caused all kinds of wierd stuff with the latch as well as with the window indexing. You may want to swap the touchpad from the passenger door to the driver's side. If the symptoms follow the touch pad, then get yourself a new one. They're only $12 or so.
