I wouldn't have arrested him, I would have just made sure he didn't drive anymore that night and had a safe ride home. I have friends who have had that very situation happen to them in the past.

When my BIL was staying with us, he went out one night and got drunk. He did get pulled over, and his car was impounded. No idea how he got back to the house, but he was very sheepish in the morning. He had no idea which department impounded his car, so we had to call a number of towns to find it. He got lucky that night, as it could have been, should have been, a DUI.
