Forensics showed that the bullet that killed her had ricocheted off concrete first. I don't think she was his target. I think he missed his target and she was caught in the line of fire. Since the prosecution didn't have enough to prove that, they went for the first degree murder charge with the slain woman as the intended target. An overreach by the prosecution, considering the evidence. And maybe by design, considering the town. Whatever the case, prosecution blew it.
