It was a non-violent crime, so not a felony. When the laws were changed about 8 years ago here with prop 47 and 57, crimes committed without guns were determined to be non-violent. I remember a local Mexican raped a girl at knifepoint and was let free because he didn't do it at gunpoint and it was considered non-violent. Not kidding. You cannot make this shit up.
