Lets see how this shooting plays out.
 
The initial story is pretty simple, 16yo kid with no cell phone drove a few blocks away to pickup his brothers, arrived at the wrong house, rings the doorbell and is greeted by a headshot.

Ben Crump has been retained already.

Missouri has a stand your ground law and a covered porch is considered a part of the castle...

How will this story change as time goes on?

Kid should have been a cop. These cops went to the wrong house in the middle of the night and killed a homeowner who had a gun when he opened the door to see who was banging on the door.



Listening to the tapes, they weren't even sure if they were in the right place. House was completely dark. But hey, shoot first, eh, guys?

Chief backs his cops who killed the homeowner right in front of his wife. They shot at the wife, too, but missed.

It should. Cops wake up a guy in his own house and murder him, try to murder his wife? Terrorize the kids? He said, "Really? Just who is going to be pounding on your door demanding to come in at 3:00 am? Pretty much nobody except cops. The question isn't what gun would you use, it's why would anyone answer the door at 3:00 am?".

Well, that's pretty simple.....

But once they kick the door in without announcing who they are it's a different animal.

ASSUMING the initial reports are true, the guy has a case. Homeowner shot the kid, kid went down, then homeowner shot kid in the head. Must have been a graze head wound, because kid was able to go to a neighboring home where they neighbor called for an ambulance.

Again, let's consider the initial reports often are not correct, but if these are, it looks bad for the homeowner. Frankly, I think if that happened to me on my quiet cul-de-sac, I'd turn on the outside light and if I didn't recognize the person, I wouldn't open the door, just talk through it. Then again, some people have solid front doors with no glass where that might not be possible.

Edit: In practice, I don't know how much there is to actually get from the homeowner. Insurance company will pay out policy limits, the homeowner will declare bankruptcy. If the homeowner has a significant amount of savings, Crump can probably get that, but I think bankruptcy laws protect the actual house and a car or two, especially if there's a mortgage still on the house.

Sounds like he wanted to die. I've been answering my door with gun in hand for 40 years, cops included, and nobody has been shot. Know why? Because there's a big difference between opening the door to talk with a stranger and speaking through the wall.

Don't open the door to a stranger regardless of who they claim to be, what they want (excepting girl scout cookies), or what kind of clown suit they're wearing. Talk through the wall. If they have a problem with that they can leave, stand there talking to themselves like an idiot, or try to force their way in. Their choice, I ain't particular :D
