Lisa Madigan Defends FOID Proposal - Riverbender.com News


Illinois Attorney General Lisa Madigan is defending the decision by her public access counselor that would make public the names of those who have Firearm Owners Identification cards. Madigan says staff in her office examined case law when making the decision to make public the names of FOID card holders and the cards’ expiration dates. She says changes to the Freedom of Information Act allows for a public access counselor to review denied FOIA requests and determine, based on previous court rulings, if the denial was legitimate.

The matter came to the attorney general’s office from the Associated Press, which requested the names of FOID card holders from the state police. When they were denied, the AP appealed to the public access counselor for an opinion. While opponents say the findings break a promise of privacy between the state and gun owners, Madigan says there was nothing in writing to that effect. “We look at the actual statute, we look at any case law that is relevant and in those circumstances as we’ve done here, the FOID Card Act does not require that that information is private, so there’s no provision in the law for that,” Madigan said. “The federal and state courts that have looked at these issues have essentially said that when you apply for some form of a license that that is public information.” As for a potential challenge in court, Madigan says it depends on what the Illinois State Police decide to do as far as releasing the information. The state police issue the cards and keep a database of gun owners. :beat: :slap: :kick:

I want out of this cesspool state so bad I am even considering taking a $20,000 loss on my home to do it. However, my step dad's health is failing and I am the only family he has left other than his sister who is older than him. So, here in Hellinois I stay.

We have the most corrupt state in the union. I agree. We have been looking,but with my job it is tough to find another one without taking a big hit. Plus,most of the family is here.

I think that if you could ever have Chicago and surrounding counties be "ILLinois" and everything south of that another state...the new state wouldn't be so bad.

We have been lightly looking. With where we live now,we are about 35-40 minutes north of STL and in the country and we don't have to go thru any big towns or STL since we work on the north side of STL. If we move we want to find some acreage,so we would have to move about an hour out to find any land and have to deal with traffic on the interstates. :willy:
