Florida No fault auto ins....serious....
 
Some of you may recall that some asswhole slammed the rear of my wife's car at what the police report says 45 mph....that is min speed IMO.....

at any rate, the POS SOB was ticketed for 'careless operation' worth 164 bux....payable in 90 daze.....

THEN he was ticketed for operating without a valid license, meaning revoked/suspended/etc.....another NON arrest ticket for 164 bux.....

so the sob walks for free, while my wife is in pain/slings/problems for ten days now....

of course he has a policy with a very difficult company called Peachtree Casualty and they are jacking me around a good bit.....

Linda waved off on a rental car, due to she was not in shape to drive.....NOW they don't want to grant her one....ten days later, when she CAN drive....she is such a kind hearted soul she just wanted to be fair.....

and so is getting screwed over now, they don't want to do shit....

and so to get into the legal shit over this FLORIDA NO FAULT bullshit.....

seems OUR insurance has to pick up her MEDICAL.....seems THEIR insurance has to pick up no more than the car's value....in spite of me keeping it up and in top condition.....

and that will not even cover a replacement car....much less one in same condition.....

4 new tires, fresh engine, new water pump, hoses, all that shit.....

trans was fine, brakes fresh and new....interior clean, exterior fine.....

30 mpg......and it being her only new car in her life....bought it herself in '99.......

so any legal advice??? .....

The only illegal Cuban is one that hasn't been caught and made legal yet.

I can't tell you how much I feel for your situation in the accident. The insurance issue is all on you as since the guy who crashed into your wife's car was not licensed there would be no insurance in effect.

Hope for a complete recovery of your wife's health.

As far as recovering anything from the other driver you are probably in lawsuit territory and if he doesn't have anything you won't be receiving anything.

One who specializes in Personal Injury Claims.

Remember, their fee is usually about 33% of a final settlement.

:dance: Krazy twist, there WAS supposedly insurance, it was HER car,and she was the passengers, and so covered.....it was HIS fault, both with different last names but hers was Hernandez.....and so probably illegal.....

After mucho hassle I got hold of the offending company claims rep and so he as much as said....sue us....in a nice 'inoffensive' way.....

and so I finally got hold of a lawyer, my wife wrote down the number to call him on......he had already been in touch, sent a note of he representing her/us I had NO clue he was THAT much involved, and went handling it myself....freeking holiday season....

I HATE the year's endings...nothing ever goes smooth, always some bullshit, and it's getting worse, and all I do is stand there as a freeking target.....hate to drive at night, and/or over any holiday time.....

OP, I know you hate lawyers and the legal system, but if you want any relief, you've got to hire a lawyer. Asking for legal advice here is all well and good, but it doesn't change what I just said.

I would not accept their not giving you a car to use. Let them show you/fax you/email you the part of their policy that states this. Also, not that they should have to, but you pay insurance for just this type of situation. You can collect from yours, sue them and/or thiers. Anything you collect over and above what your insurance paid you, is yours.

We have a lawyer, due to wife and a client of hers....she had to call him because of her being unable to keep the books for a few weeks....

so he got involved on a scale we knew or SHE did not understand....seems that OUR insurance is supposed to pay for her hospital bills, NOT THEIRS....that's bullshit on the deepest order....

SO WE GET STUCK with the ensuing rate increases over this shit....BET on that.....

and the judges get paid under the counter too.....BET on that one....

SO we get a print out from the offending 'party' claims adjuster, and his appraisal.....

so allowing 1500 bux WITH tax on a car I can NOT find the equivalent, for less than about 2500 by time sales tax and tags and shit is done....

we need a new physical tag issued, as the thing is looking like total crap.....


SO wife/we send a email to them, and a phone message to that adjuster who is conveniently off duty till end of year or more.....and so....

to talk to his BOSS, if possible......


I believe we don't have to settle for cash, they have to replace the CAR with like kind and quality.....

WE don't have to shop.....efff em forever....


I need an address, the numbers all relate to Georgia.....

I ready to 12 ga their asses....cost them a HELL of a lot more than any stupid jacking around over some claim......I suppose they are self insured....for such casualities.....

He was/is doing Linda a favor, I have to think, and his opinion to ME/US is that we can do nothing more.....

I, however, am going serious ballistic on these assholes......they NOT walking away clean for a lousy 328 bux in fines, and putting MY wife in the hospital for 6 hours, and in pain/agony for 3 weeks, all black and blue, and then they want to steal the CAR on top of it???

Think for a nanosecond that Regressive will NOT increase her rates to UNaffordable???

I am told the hospital eats the other 20%, bet me on that?? think I believe it???

and the owner/driver were in the car....bet they moved by now, any takers???

that leaves the crooked insurance companies and judges....and NO, I Have finished filing ANY claims for any THING in the Florida/Federal courts....I"d rather just shoot the judge than bother.....
