Got rear ended by a 91 year old guy driving his minivan. Poor dude, Korean war vet like my dad. He totaled his car. Straight section of road, clear weather and daylight. I saw him behind me and slowed down gradually, with my turn signal on to turn right onto a gravel parking lot. He said that he just didn't see me.

He can make a claim against his insurer under either his collision or his uninsured motorist coverage. Each option comes with a deductible. In theory, his insurer will pay out, then subrogate against the at fault party, and if they collect from the at fault party, they'll issue him a second payment for his deductible. In practice, that's a rarity.....the kind of people who don't carry insurance don't pay up and most are judgement proof, in a "can't get blood from a stone" type situation.
