Florida Stand your Ground Law
Just curous what your opinions are on this? From what I saw on TV, that guy should be charged. Having a CCPermit along with this law should not allow you to go and pick a fight, then when the tables turn, pull a gun and kill them?
Souns like something right out of South Park being allowed to shoot at anything as long as you yell out "it's coming right for us!" |

The girlfriend is a complete fuking idiot. And the dead guy is a dead fuking idiot. You wanna be a tough guy and push people down? Expect it to go bad.
|
As usual, video doesn't tell the whole story of what led up to it. If I walk out of a store and you're talking shit to my wife in her car, yes, I will probably knock you on your ass. I would say something first and warn you to get away from her. I don't know from this video whether he did so or not. |

The correct response by the girlfriend or deceased guy should have been, "gee, I'm sorry, my bad, I'll move the car." Apparently the dead guy parked in a handicap spot, leaving girlfriend in the car. Our Dirty Harry approaches girlfriend and informs her the car is improperly parked in a handicapped spot. Words are probably exchanged. Meanwhile, the soon to be deceased illegal parker comes out and immediately wants to be Billy Badass. Um, no, you don't get to just walk up and immediately shove somebody down on concrete pavement. Our shooter could have hit his head and died right there. I would say he had every reason to believe his life was in danger. It was a good shoot, IMHO, and the lesson here ought to be, be courteous and follow the law. |

A person armed with a knife is considered an immediate danger to anyone within 21 feet. ( given for distance that can be covered in seconds ) The deceased pushed the shooter down onto a hard surface. For all the shooter knew, he was backing up to give him a solid kick in the head. Plus the deceased was approximately 20 years younger. Justified use of the Stand Your Ground law. ~~~~~~~~~~~~~~~~~~~ This could have all been avoided if the deceased vehicle would have been legally parked. |
I think the danger to the man pushed down was not over at the time he pulled the gun. I say he should be allowed to have that defense.
I do feel a need to explain that I am not a qualified LEO, prosecutor or Judge but I am a retired CPA who has actually witnessed many Law and order programs. I am confident in my assessment. |

The dead dumbass picked the fight when he went up and shoved the shooter down on the concrete. See the difference? |
From what I saw, the dead guy laid hands on the shooter. That was a hard put down, a assault and battery by most definitions. The shooter was much younger and to me look much smaller.
If up to me to decided the fate of the shooter I would have let me go also. Of course you know the family of the deceased tough guy is going to take this into civil court. |
What the hell is the controversy? What kind of moron thinks that if someone assaults you, you should be legally barred from defending yourself? Was the shooter supposed to just cross his fingers and hope the violent criminal who just committed a violent criminala act against him would suddenly snap into a peaceful state of mind and not seriously hurt/maim/kill him?

I can see both sides; 2 dumbshits collided. No reason to get so physical just because someone is yelling at your wife/GF, IMO. But it looked like the dead guy was backing off as soon as he saw the gun come out. Of course, we have no idea what words were exchanged, what threats were made, etc.
Providing some insight into how the dead guy & his "woman" see (saw) themselves, in an interview, she said "He wanted me to, you know, move mah car. But, you know, I have mah right to park anywhere I wanna park." |

I believe everyone involved was wrong - from the store, the family parked in the handicapped space, the joe blow reprimanding them for doing so, the bad ass protecting his girl, to the joe blow who became the armed man who shot the bad ass. Everything that happened was uncalled for and completely unneccesary.
The store is not incompliance with federal ADA guidelines. Family is illegally parked. Armed man is yelling at wrong person. Bad ass assualted armed man. Armed man should have just laid there and filed charges. (BTW I saw the bad ass stop and move back towards armed man right before he was shot.) But all of this could have been avoided if the privaledged family who think they can do anything they want - wold have parked in any of the other 6 available spaces I can see in the video. :toetap: |
