we had a great time, was coming back and following a guy in front of me doing around 70-75 mph, seen a cop and immediately slowed down to 55mph , he puts lights on, blows by me so all clear, the next second he starts pointing towards me also, what does VB think, i plan on fighting this, he clocked me at 74 mph at a 55mph, it just sucks because its over 140 miles away from were i live

Sounds like he wrote it to keep it under 20 over. Pay the fine and chalk it up to experience.

Well, of course I don't know the law in your state. But on what basis are you going to fight it? If he has you on radar doing 74, what are you going to tell the judge?

Most local gov'ts will let you plead guilty with a PBJ for minor traffic offenses, pay the fine, no points...........I said most......:D

There are a number of express legal services that will plea this to a non-moving, no points violation. Some jurisdictions may let you do that yourself, but I wouldn't count on it. It'll cost a couple hundred, but you will pay that in insurance premium increase plus have points on the meter if you don't get it fixed.

You're done.... if it is a small town type thing, go in, talk to the prosecutor and tell him you're willing to pay the fine but would hope that your clean record would be taken into account and see if they'll put you on probation- most courts will, and if you don't get another moving violation in six months, it never shows up on your record and is assessed as a civil penalty....

Then see how much an assault charge will cost you, pay that too, and go hunt down your running buddy and whip his tail for cussing and yelling at the cop. That guaranteed both of you a ticket, since there was no way he was leaving without one and he could bring it up in court if you had not been ticketed..
In 14 years of doing this, I've had way more people talk themselves INTO tickets that I had no real intention of writing than I ever dreamed of....

Alternatively, you can string it out by pleading not guilty, then asking for postponements on the trial day and hope you catch a day that the cop doesn't show up for trial. And file discovery for the training records of the officer, and the last time the radar was certified, then get in court and ask him how far he tracked you before verifying his observation with the radar, ask him if he saw the big truck travelling nearby, ect....
You are gonna spend WAY more time and money fighting it than you can imagine, though...and you run the risk of the judge seeing through the BS or, you muttering that you just was going that speed momentarily, and being found guilty...:lol:

Good luck. Locally, (small town Arkansas) the prosecutor is more than willing to work a deal and clear the case. Only ones I've ever saw them get really wound up about is one that showed their butt, either in court or on the street.

What?....how could he have clocked both of you at the same time? You must have been a little ways behind for him to get a read on you. I generally tuck in right behind a speeder so they are exposed only. You could fight it based on that but in a small town you're toast anyway I figure. :(

i was very close to the guy in the front and as not really watching the speed was just cruisig coming back from a weight lift meet, so as the LEO pulled out i assumed dayum this LEO is flying and then realized holy crap hes not just going after the guy in front of me, but i was also included

and by the way my son won the silver medal in weight lifting there were over 50 contestants, so besides the speeding ticket which here in LI they wont even blink if you go that speed, was

Depends on if the two states reciprocate. If not, then you pay the fine and nothing on your driving record. :seasix:

Problem is, forty-five states and the District of Columbia participate in the Driver License Compact (DLC). Georgia, Michigan, Wisconsin and Tennessee are the only states that don't participate in this interstate compact.

well i opted out of pretrial hearing , and will be seeing the prosecutor first hand, hopefully he will just ask me just to pay the fine and be done with it, one of the problems is that i have a 2 hour ride their and back, well it is what it is, just hoping for the best

From an insurance standpoint it may be worth your while to go before the judge and see if he'll let you off with just the fine and no points. I do this by default now since its not about safety its all about money. I simply state that I was in fact speeding, but it would create an undue hardship with increased insurance premiums. Can I pay the fine and have the points waived. Works for me.

They've increased the cost and penalties enough that I don't risk it much any more. ESPECIALLY in Virginia (IE Nazi state)

If the first car was close to you you might beat it by saying radar picks up the closest object which was the first car. You were going slower so radar wouldn't clock you also. If you drove past cop who was sitting alongside road with radar you're farked.

well originally i seen the LEO pull out and fly past me, so of course i slowed down , but when i seen he pulled the guy in front of me over i continued on my way, not knowing 20 seconds later he would be coming after me, figures they say the judge was a former state trooper, aww well i will get my spanking and take it like a man, will let you guys know what happens when the trial happens, hopefully there will be a plea bargain
