View Full Version : Id bet money, im going to have problems titling this truck

I bought a truck last year...had some issues, its been a long project but Ive got it all fixed up ready to drive, just realized this afternoon that I probably should have gotten the title work out of the way before dumping hours and money into it...

When I bought it, it had a lien on the title.

The seller, was repo man, who repo'd the truck the previous year, but really liked it so he kept it and just started paying off the lien to the bank, the bank held the title the whole time.

The tranny shit the bed...so he sold it to me. He drove up to Birmingham to the bank that held the physical title, and retrieved it, along with some paperwork showing the lien was satisfied, and the title is signed by the lienholder.

So I have an alabama title in the guys name that sold it, also it has the name of the lienholder printed on it in the center...

On the back of the title it is signed by the bank, selling it as the owner...

I also have a Bill of sale from the seller, and a Bill of sale from the bank, and a disposition of lien from the bank, releasing the lien it is notarized.

So, I have proof the bank released the lien in full, and proof the seller sold it to me...

But here is where I think Im going to have problems...The front of the title has a small area near thr bottom for "release of lien from lienholder"..where they can sign it with their business name and the signer's signature...that field is left blank.

But then I have the notarzied release of the lien, everything has the VIn number on it at least..

THe original owner who had the truck repoed from him....

The repo guy that got the truck and was paying on it

The bank

ME, the buyer.

I can prove it was repoed, I can prove the bank got the truck back...I can prove the lien was paid off...and the "Buyer" field on everything is blank..so..would I just put my name in as the buyer..so technically im not buying it from the seller, im buying it from the bank?

I hate titles..

The big crime you have committed is not paying the sales tax for the truck in a timely manner. I'm sure your state gives you some time deadline to register (read: pay the taxes and fees (also read taxes) a vehicle you purchased. I'm also willing to be there is a monetary penalty for not paying that tax in a timely fashion, which you failed to do. Get ready for your wallet-ectomy.

There is a 30 days grace period to avoid a 20 dollar penalty...

Thats nothing....

225 for a tag, 7.5% sales tax on a 2000 dollar truck, 90 dollar title fee...plus tax on all of it..im looking at nearly 500 bucks to get it all done.

If you have a tag laying around not on the vehicle you won't pay the 225, you can transfer to save on that, also if the truck is over 5k lbs it is consider to be in a different class for trucks and you won't pay the 225 either, if you pm me the vin or title number I can run an inquire on it and can tell you if you will have any issue with that title

Also having a discharge of lien letter is just as good as having the title signed off, as long as it's the original lien release. You won't have any issues!

Although the lienholder is supposed to release it's lien by signing the title on the front, seems to me just form over substance since you have a separate release. Argue to the title people that you have substantially complied with the law and no where does is say you have to strictly comply with the title law.

What kind of Truck? Pics?

This is the Green 95 K3500 Big BLock 4X4 truck I got last year. Got it with a bad transmission...so I had it rebuilt, and found our tight away the truck had some issues.

Ran rough, idled too high, 4X4 didnt work, lots of burnt out light bulbs, bad brake lights, no power...bad exhaust...

I put in a chip, new computer, replaced every sensor under the hood, rebuilt the TBI, new fuel filter, new injectors, replaced the intake gaskets, all new ignition system, retimed it...new exhaust system put on...straight piped off the Y pipe into a single in dual out flowmaster 40.

I put on the complete ranchhand legend series kit..bumper/guar,d rear bumper/hitch, and the headache rack and rails.

Replaced the cracked windshield on Friday...the cold winter turned the chip into a full length crack.

New wipers, also fixed the ignition cylinder that was sticking...

only a couple minor things left...the LF fender has a dent that can be popped by a paintless dent pro...and Ive got to put on a new shift cable, this one has alot of slop in it.

Only tags Ive had were my vette and my Jeep..and both of those are already assigned to my 95 K2500, and 94 K1500.

Im happy the legislation is in motion to reduce this fee though...but it wont do me any good this time around.

So what we've found out is...

Possible odometer rollback some years ago, 2 odometer readings had a like 2 or 300 mile change in the wrong direction...

Lien is still listed as intact against it, but with the paperwork I have, it shouldnt be a real issue...hopefully.

Not planning to sell it, but if I were to sell it, id look to get about 5000-6000 for it, after I put new tires on it, and get the dinger in the LF fender popped..ill have about 6000 in it, but I never bought this one as an investment, its just so rare to find a clean, big block, reg cab, SRW 1 ton..I had to have it.

The 95 2500, Ive turned down cash offers of 7000 and 7500 for it...

Ive got 2 people that call me every 2-3 months offering 5000 and 5500 for my Z71..
