Cliffs: Guy's two kids are hit and killed by a drunk driver.

Drunk gets shot to death.

No one sees who shot guy.

Dad on trial has no gunpowder residue on his hands when tested that night.

No gun found.

Most everyone in the county thinks the drunk had it coming.

The only thing they have that has been reported is, the same type of ammunition used in the shooting was found at the defendant's home. There is no proof that the guy ever owned a gun in that caliber, though.

Yeah, but what you never seem to hear mentioned is the $50,000 in attorney fees the guy has to shell out, along with probably losing his job and worrying about what happens if things go south during the trial.

Our criminal justice system is a legal system, not a justice system.

it's bullshit, no evidence, and understandable anyways even if there were. Although I fear under a crime of passion (minimal sentence) or temporary insanity (could have issues that comes with this one too). I don't understand how this case got through a grand jury in texas.

I won't say it was justified as long as the guy was no longer driving, if his car were still moving, then elimination of said threat would have been justified too.

I wouldn't go so far as to call it a legal system. Its definitely a system though. :cert:
