MYRTLE BEACH, SC (WMBF) - Murder charges were filed against Tammy and Sidney Moorer for the alleged murder of 20-year-old Heather Elvis, Horry County Police officials confirmed Monday morning.

the HCPD states there is probable cause to believe that they kidnapped Heather Elvis and murdered her at Peachtree Boat Landing on December 18, 2013.

The warrants for the murder charges state that Tammy and Sidney Moorer "did unlawfully, without just or sufficient cause, murder Heather Elvis with malice forethought." The kidnapping warrants state that the couple "did unlawfully seize, confine, kidnap, abduct or carry away Heather Elvis by any means whatsoever without the authority of the law."

The warrants for the Moorers claim the coupled murdered Heather Elvis with "malice forethought." Those two words have big meaning for the Moorers. Under the South Carolina penal code: "The killing of any person with malice aforethought" has a minimum punishment of 30 years, and a maximum of life imprisonment or even the death penalty. Solicitor Jimmy Richardson says he probably won't seek the death penalty in this case.

Horry County Police won't say what they found, but they will say that through the process of elimination at the evidence recovered from the home on Friday, they know who kidnapped and murdered Heather Elvis back in December.

On the WMBF News Facebook page, news of the murder charges were met with some confusion. Many people wanted to know how a person can be charged with murder if the victim is still missing. A law enforcement official said murder charges can be filed without a body only if investigators have found enough evidence to prove the murder happened, through multiple pieces of evidence.

Horry County Police Chief Saundra Rhodes said police located evidence inside the Moorers' home and on their property during the search Friday that gave them probable cause for the murder charge.

"We had a good amount of evidence and the stuff HCPD found, added to that evidence," said Solicitor Jimmy Richardson.

"We have not located Heather," Chief Rhodes said. "That is something that we are still looking for." Chief Rhodes said the investigation is still ongoing, but evidence located on the property led to the charge of murder.

A bond hearing for the murder charges is scheduled the week of March 17, 2014.

Tammy and Sidney Moorer were arrested Friday, February 21 while police executed a search warrant at their home near Socastee. On Saturday, both were charged with obstruction of justice and two counts of indecent exposure. The next day, both were charged with kidnapping in connection with the Heather Elvis case.

On Monday, the Moorers were placed in protective custody at J. Reuben Long Detention Center, confirmed jail director Tom Fox. He said they have been separated from the general population for their own protection.

Family and friends are calling out to S.C. Gov. Nikki Haley to reach out to the family, according to a post to the “Findheatherelvis” Facebook page.

“If there is anything you can do in the search for Heather, I ask that you do whatever you can to help,” the post states. “Your personal contact is requested on this matter. Please respond quickly.”

The post calls upon people to email Haley, as well as comment on her Facebook, Twitter and Instagram pages.

The search for Heather Elvis has received nationwide attention since she was last seen in the early morning hours of Dec. 18.

Talk show host Nancy Grace aired two segments about Elvis. FoxNews, MSNBC and Good Morning America have also aired stories.

Horry County police spokesman Lt. Robert Kegler has said there’s no person of interest and investigators do not know where Elvis went after her date. Kegler also said there is no new information that police can release at this point.

An Horry County police report filed late Dec. 19 said Elvis left her River Oaks apartment on White River Road on Tuesday, Dec. 17 at about 7 p.m. to go on a date.

The report said Elvis and her date, who is not considered a suspect, had dinner, drove to watch Christmas lights and then went to the Inlet Square Mall parking lot in Murrells Inlet, where Elvis’ date taught her how to drive a standard transmission automobile.

It was from there that Elvis texted a photo of herself driving a manual drive vehicle at 10:43 p.m., the report said.

Elvis’ date told police he drove her back to her apartment at about 2 to 2:30 a.m. Dec. 18, according to the report.

He said Elvis went inside her apartment and that her vehicle was in the driveway.

Elvis’ vehicle was found Dec. 19 at the Peachtree Boat landing in Socastee, about eight miles away. The police report does not specify the exact time the vehicle was found. Much of the police report is redacted after that.

The report does reference a business that had video surveillance of the drive-thru window, surveillance that captures a facial picture of every driver that comes through the window.

But details about the surveillance, including the name of the business, were also blacked out from the report.

A $25,000 reward is still being offered for information regarding Elvis’ whereabouts.

Police records discuss phone calls between Heather Elvis, older man as late as 6 a.m. December 18


Horry County police records are focusing on telephone activity that occurred as late as 6 a.m. Dec. 18 between Heather Elvis’ cell phone and a man with whom she had a relationship history, according to documents obtained by the Carolina Forest Chronicle.

The phone activity occurred about four hours after Elvis’ last known whereabouts on Dec. 18, and the man identified in the report was nearly twice her age, documents show.

Elvis’ roommate, the police report said, told officers that Elvis “seemed like she was crying and upset” after Elvis reported a conversation with that man.

Police are also reviewing reports about another man who may have been a coworker of Elvis.

A police report describes the possible coworker as “possibly being abusive” and “possibly violent.”

Horry County police spokesman Lt. Robert Kegler said both men identified in the report as being connected to Elvis have been interviewed.

The Carolina Forest Chronicle has not identified the other persons in the report by name because no criminal charges have been filed. No suspects or persons of interest have been identified, Kegler said.

The last person to see Heather Elvis was 21-year-old Steve Shiraldi of Murrells Inlet. Shiraldi said in police records and in a telephone interview that he drove Elvis home and dropped off sometime between 2 and 2:30 a.m.

Kegler said Shiraldi has been cleared of any involvement in Elvis’ disappearance.

“The case is difficult for anybody to talk about, but it [the investigation] is very active at the same time,” Kegler said.

Elvis, 20, disappeared sometime after Shiraldi dropped her off at her River Oaks apartment when their date concluded in the early morning hours of Dec. 18.

Her vehicle was found abandoned on Dec. 19 at the Peachtree boat landing in Socastee, about eight miles from her apartment, a police report said.

Witnesses talk about Elvis

It’s been widely reported in police records and media accounts that Elvis left for a date at about 7 p.m. Dec. 17, and that she returned to her River Oaks Drive apartment sometime between 2 and 2:30 a.m.

It’s also been widely reported that Elvis text messaged a photo of herself to her father at 10:43 p.m. that showed her learning to drive a manual transmission vehicle.

Elvis’ roommate, identified in a police report as Brianna Warrelmann, received a phone call from Elvis at about 1:44 a.m. Dec. 18, police records state.

According to the report, the roommate said the victim “seemed like she was crying and upset” due to receiving a call from a man the report says was nearly twice her age.

The report also said the victim previously had a relationship with the man, and that he said he left his wife and wanted to be with the victim.

Warrelmann declined to discuss the nature of the phone call when contacted by the Chronicle.

Horry County police are following up on leads concerning phone activity between Elvis’ phone and the man who’s nearly twice her age, police records show.

A police report says Elvis’ father contacted T-Mobile, his cellular provider, which the report says provided him with a call history for the victim’s phone.

According to the report, the last phone calls were at about 6 a.m. Dec. 18, about four hours after Elvis and Shiraldi ended their date.

The calls were back and forth between the victim and the older man, the report said.

The older man told police he hasn’t seen the victim since October, and then admitted to speaking with Heather Elvis the previous night, the report continued.

He further told police, the report said, that he “called her to tell her to quit calling him and that was it.”
