I was goofing around on Ebay last night and came across this:

3 of the 5 pics are of Sneaks. They vatored my pics off the interwebs, cause I didn't give this company permission to use these images. Should I shrug it off, or sue them for eleventy billion dollars, a tuna sub from Subway, and a case of 20 year old scotch?
Someone here can have the scotch. :D

Are you claiming a copyright on your images?

If you seriously expect to get something from this, they have medication out there you can consider.

In a nutshell, they're using your images to sell stuff. They profit from using your images, so you deserve a fair cut. Damned right I'd sue them.

I know how that happened, photog came and asked if he could shoot a few, you got all flustered, head swelled up and you said, "yeah man!"

I see the car is staged, you would never park like that regularly, so I'm guessing it was a "knock yourself out, send me a few pics". Hummmmm Timbo?:D

Actually Normy, my buddy Ron took those summer before last, with his new Nikon. He printed me off a couple really nice copies that he photoshopped out the golfers in the background for me to frame.
Reminds me to call him. He copyrights all his other pics. I'm on the eleventy billion trail like a fat kid goin' after a Ho Ho.......:leaving:

The best you can do is demand they stop using your pics. You can't sue for damages unless you registered the copyright. That difference is THE reason to register a copyright.

I've had this happen to me before. Not on ebay, but CF vendors using pics of my car to sell a "similar" product as what they were pushing...Not even the same as they were offering.

I normally don't care if someone uses my pics, but not when they're false advertising. I asked them to stop, they got pissy with me about it, so I then cc'd savewave the PMs, and those pics vanished within seconds.

Ebay will remove the listing if you report him..

Using even factory logos, or photos are against the rules, enough warnings and they will eventually suspend the seller.

If nothing was exchanged (no contract, paid for service, etc.) who owns the picture, the owner of vehicle or the photographer?

Now, as for forcing them to take down pictures someone else happened to take of your car in public, good luck with that.Those images ARE copyrighted, same as any picture someone takes. It's implied though, not registered.

Generally speaking, people know very little about copyright, and accepted uses. And when a threat is launched even mentioning the word copyright, people generally freak out and comply...Just because they don't know any better.

As stated above, in this instance there is an advantage because Ebay is the venue. Ebay can and probably will take action against that seller if a complaint is filed. They don't need nor want to investigate it any further and don't wish to subject themselves to any possible action of recourse.
It may be the seller's wrongdoing that they appear there, but those images in question are now being stored and hosted on Ebay's servers, making Ebay the ones ultimately responsible for the misuse.

The lug pattern should be the same. You would have to check the offset.
