We found a replacement car for the one Linda was almost killed in, now the friggin' offending insurance company will not pay for it, Peachtree Casualty out of Californica, Georgia, and maybe Texas will not pay enough to fund a decent replacement car.....lousy bastards.....been fighting all day with them yesterday.....

All we want is like kind and quality, and they flat refuse.....

:issues: SO they have some release form to sign, I suppose that means we can't sue and have a chance of collecting anything.....

I have to find out what it costs to sue these days.....

everyone says it's a time waster though.....

guess maybe their Orlando office needs a 12 ga.....

It's my understanding they are under no obligation to replace it with what you consider a similar car, but rather to pay you the value of what was totaled. What's the value of your wifes car according to edmunds/kbb etc vs what was offered? Also did your wifes car have an accident history? If it did, that would cause them to hit the value more as well..

If you really are unhappy contact a local reputable bodyshop. They should have the number for a guy that specializes in negotiating up insurance claim amounts on totaled cars. Your only problem though may be that what he charges may eat up what he may be able to bring the value up to..

You can fight the valuation, you will need to hire your own appraiser though. We did it with Karens G6, but in the end only made up about $1,000.

Somewhere along the way, I can't help but think you must have said the wrong thing to the wrong person and really pissed somebody off. I have been in a few accidents that were not my fault and never had the problems you are having. Given your past posts, if you sign that release without legal advice, you'll probably regret it. I have NEVER signed a damn thing until it was CRYSTAL clear what needed to happen and it was in writing.

Linda's 'lawyer' is a client of hers, helping out with some advice and a few minits time for what we hope is nothing, he is VERY pessimistic as this PEACHTREE Casualty company is a royal rape job on any claims, they have a reputation that is far and wide.....which brings up the 12 ga.....some folks have to learn.....the hard way.....already told the 'adjuster' in Atlanta burb that I have his address, and location......he don't seem to give a damn, he knows I not heading to Atlanta over this.....

but Orlando is close by.......

SO for all the black and blue, turning purple and orange beat up hurts and crap and STILL not walking normal on her left leg, the bastards NOW want to screw US out of 500 bux on the value of the car.....

EFF em forever, some claims need settled, and I have some beefs with the 'florida' legal system, even at the federal level.....

this shit goes back a while, and at age 68, I think some bastards need a new found college education......

Cant be any worse than dealing with USAA....

I had my 85 vette, I was at night school, car was parked in the first parking spot, empty parking lot at 8:00pm....one of the teachers jammed his car in reverse and slammed into the LR corner of my car. Now up to the point the car ran like new, paint and body was all original and 9/10 overall..shined up like a new penny. He hit me hard enough to move my car about 2 feet sideways. I actually was walking to the car and saw it happen in front of me.

He used USAA...I called them and reported it, they sent out an adjuster, he looked over the damage, it need a new bumper, all new trim, and the quarter was cracked pretty badly and none of it lined up right, the gaps/seams were not right, and it bent my brand new muffler all up.

He writes a check for...as I recall, $400. I told him that wouldnt even cover paint, and that they would at least have to paint the quarters and bumper..he told me ot take it or leave it, so I left it. I took the car to the only body shop in town that would touch a vette...he got under it, looked it over, and told me it would need a new bumper, impact bar, muffler, and he advised replacing the 1 quarter as it was cracked deep and its likely the mounts were ripped out. He wrote an estimate for 3200, which included painting up to the doors, new bumper, and new quarter, and a new muffler.

I sent the estimate to USAA, they called back and got really rude, told me that they would like to send out a specialist to assess the car..so this guy came out..looked it over, he said he was a boat/fiberglass guru and did almost all of the vette stuff in the area..he said "Well, here's the deal, its a ratty old vette with 150K on it, we will buy you a salvage yard bumper, a salvage yard OEM muffler (not what I had on it) and would pay to have the quarter repaired, but would only paint the bumper, and blend the quarter, he wrote a check for 600 dollars. I gave him the estimate from the repair shop...he laughed and threw it back at me..i called the rpeair shop and he talked to the adjuster...and it was a deadlock.

Shop refused to deal with junkyard parts, and USAA refused to buy new parts....

I ended up taking 600 dollars, getting a muffler, realigning the bumper as best i could, and bought new trim, but it was never right, but hell...I could only afford so much.

Insurance is a joke..

WIFE objects, but I thinking of seriously dropping ANY AND ALL insurance , that includes homeowners, screw the bank, they are upside down over 40 grand on this house now....reversed out when nobam was on the horizon.....

WTF, if that's all they cover...??? why pay 800 a year to drive a car???

shit, I paid 600/ year in Maryland to cover THREE vehicles for 100/300 and TWO of them had full coverage....

Wife pay that for just nothing on a DD......just liability, and she is clean record for decades now....
