Hunter Wounded by Recalled Gun

DOUSMAN-Ed Lytge was just reaching for his shotgun when it went off.

If it hadn't been for his hip wader boots, he's convinced he would have lost his foot.

It happened along the Bark River in Waukesha County.

His brother Fred saw it all.

"Just before he got a hand on it," Fred told CBS 58, "it went off. It caught me off guard. It shot up into the air."

Making matters worse is that only after the shooting Ed discovered the Weatherby 12 gauge had been recalled.

"How in the heck can someone sell a shotgun under recall and I'm not getting any answers," Ed complained after he says he called the Walmart in Watertown where he purchased the firearm.

CBS 58 called Walmart as well. A customer relations representative tells us they will offer Ed a full refund if he returns the gun.

A more formal statement soon followed:

"Walmart takes product safety very seriously. We are working diligently to find out exactly how this may have happened and we are determined to getting to the bottom of this.

We are glad to hear Mr. Lytge is going to be okay and we definitely want to do the right thing. We will thoroughly review the matter and will be reaching out to the customer to address the issue."

Ed says he's handed over the firearm to the DNR.

He says it's not about the money, it's that somebody would unload a display weapon on him.

"It was their responsibilty to pull that shotgun and keep it off the shelves. It was their responisbility to send it back to get it fixed and they did not."

The safety upgrade will replace the trigger/firing assembly of the affected shotgun, and prevent a potential accidental discharge, which could occur if certain parts were to become loose. Accidental discharge of any firearm can result in severe injury or property damage if the muzzle of the firearm is pointed in an unsafe direction at the time of accidental discharge.

WARNING: If you own a Weatherby® SA-08 model semi-automatic shotgun with a serial number within any of the serial number series referred to above, USE OF YOUR SHOTGUN MAY RESULT IN AN ACCIDENTAL DISCHARGE AND SEVERE INJURY. STOP USING YOUR SHOTGUN IMMEDIATELY and call Weatherby at 1-800-227-2016 OR 805-227-2600 to receive instructions on how to return the shotgun’s trigger/firing assembly for the safety upgrade. Upon receipt of your trigger/firing assembly, a replacement assembly will be sent to you.

No problem.

The first rule of gun safety is to always keep the gun pointed in a safe direction. That way, even if the gun does go off, nobody gets hurt.

So if the gun was being handled in a safe manner, why would his foot be in any danger in the event of an accidental discharge?

Safety instructions for hunting with the Wetherby SA-08 Semi-Automatic Shotgun

1.) Never abruptly reach for the weapon. Sudden movement may spook and startle this weapon, causing it to go into flight or flight mode. Always sneak up on it from behind, making sure that it's muzzle is pointed away from you in case it should bite.

Yep, there was a recall and whether the hunter knew it or not, it was out there. i think Weatherby had no way of knowing Wally World had sold him the gun int he first place. If there is a suit, I hope it's thrown out because Elmer Fudd wasn't practicing proper gun safety and pointed a loaded weapon where it shouldn't have been. Or, since the article isn't clear, he did not have positive control of a loaded weapon and laid it down somewhere. Again, the article is vague, but Mr. Fudd is still an idiot with the gunshot wound to prove it.

I always love it when people jump to conclusions.

That article doesn't provide enough information for anyone of sound mind to decide what really happened.

Seriously, WTF, over? I still place blame on Mr. fudd for having a loaded weapon regardless if he thought the safety was on or not.
