I never followed it too closely, but the technology loopholes are just insane.

Kinda hard to. :(

The main loophole is if subscribers have their own copy of content to download, it equates to legality of personal VCR.

So, to make a cloud based DVR it would be illegal to have one copy of a movie to stream to everyone, but fine if each user gets a copy on the server to download.
