View Full Version : Parking lot accident responsibility?

We went to lunch today and a buddy drove. When he parked evidently he parked about 18” over the white line into the space in front of him. Well why we were in the restaurant someone backed into the space with their truck and tagged his bumper. Nothing real big but enough to see. I told him to stop crying that it was basically his fault. If he would have been in his space and not hanging into the other one it would not have happened. from the way he is acting you would think that he was driving a Ferrari and not a Toyota Tundra.

Here in Arkansas, that would be private property. Therefore, it's a no fault accident and each driver's insurance applies to their own vehicles.

Not his fault at all, as he wasn't in the vehicle. Should have showed the handle...

ClearBra Saved The Day!

Last Sunday while on a Starbucks run, some dopey woman in a RAV4 backed into my 430 Spider. I pulled up behind her, left five feet between us (and she had another five feet in front), got out and while walking across the street, heard a crunch. Turned around and saw her rear bumper up over my car up to the hood badge! Put both hands on my head and yelled Oh Sh!t!

She got out and said,"Your stupid car is so low that I didn't see it". Some apology. I always wondered what I would do when this happened. I just stood there silently while she wrote down her info. I guess the silence was too much for her so the next thing she said was,"Its just a car you know", then "How much can painting the front really cost", and "I know a guy that has a body shop, that will probably cost a few hundred bucks". I replied that just the clear bra cost $2000 originally and the repair probably will cost more than her RAV4. I was getting pissed off at this point.

This was a great show for the people in Starbucks, three of which gave me their phone numbers as witnesses, even though I wasn't looking for them.

So the point of the thread title is that the hideous scrapes and scratches up the front of my car seem all contained by the clear bra. It appears that the bra has saved me from having to repaint my whole nose. Doesn't look like the metal is depressed or bent. The bumper is unfortunately holed by some bolts under her rear bumper and will require refinishing. Like she said maybe for a "few hundred bucks". B!tch!

Should make him feel better.

Should make him feel better.

I don't think it will.

He's still driving a Tundra.

Sounds like neither one of them knows how to park, but I'd say the crash is the "fault" of the guy who was driving the other vehicle. Don't be backing into spots if you cannot judge how long the bed of your truck is. Geez!

:iagree: with the fact neither one knows how to park.

Seems to me that it doesn't matter if he was over the line or not, the guy backing should be able to park without hitting the vehicle already there, especially something as big as a Tundra.

:iagree: The Tundra didn't just suddenly appear. Even if the Tundra was parked correctly, the guy backing up could have just as easily hit it.

If the my buddys Tundra was parked correctly and the other guy parked in his spot which is where he was then the Tundra would not have been hit period. My point to my buddy is you took up part of his parking spot period. When the other guy was backing in he assumed he had the room of the whole spot not 2 feet less. So if you are going to park wrong and someone bumps into you don’t bitch at them you were just as wrong as they were man up and admit it.

:willy:

When you're parking, you need to make sure the spot you're parking in is clear!!!! The guy doesn't "own" that spot and have the right to bump someone else out of it!

And, seldom will two trucks fit as you're describing anyway. The guy parking who hit your friend's Tundra should have parked elsewhere.

Hey...did he stay or leave a note?

I kind of think it's the responsibility of the driver to avoid stationary objects.

Clearly, parking lots should be banned.

I don't think that he tried to bump anyone out of it
No he didn't leave a note I seriously doubt that he knew he bumped into him. It’s not like the bumper is crushed or hit with any kind of force. There is just a little spot on it. He's going to have a fit when he gets a damn rock in the windshield.

And I'm sure I could search the Interwebs and find plenty of unflattering pics of GMC trucks as well. :yesnod:

I don’t know man. My first car was really nothing special, in fact it was a second hand car with quite a few scrapes but I used to get furious if someone caused a single extra scratch on it. Ideally that guy should have left a note with contact and insurance info as well as an apology. Not that you would want car insurance companies (http://www.thehartford.com/) involved; the damage is pretty minor.

I agree, it's his fault. People who park over (or on) the lines deserve to get hit.

Sometimes the reason someone parks over the line is because someone else parked over their line and in order to park (no other spaces available) had to park over the line. We have an extended cab truck and there are very few places where that vehicle will fit (front to back) within the painted spaces. It is park it either over the line in the inner part of the space or let it hang out into the lane where other vehicles travel. I would rather park it part way into the opposing space.
