I've always gone by the rule that ultimately the larger vehicle has the right of way, so the OP fits.:D

I would still put my money on the Train in Train vs. Tank

Train vs. 120 shell is a different matter.

on the water a sailing vessel has the right of way, unless you're in the shipping lanes or an aircraft carrier is coming at you!:rofl:

Whats' the old joke about the destroyer captain in the fog seeing a light and telling it to give way?

The voice from the light and he go back and forth telling each other to change course until finally the destroyer captain has had enough and declares "I'm a United States Navy Warship and you will give way or I tell you we will run you down."

The other guys says - "Well, I'm a lighthouse and if that's what you want to do, come right on ahead."

This must have happened in the days before radar became commonplace.

One of the railroads we used to own goes through Fort Benning, and we had a grade crossing accident with a tank there. I woulda scored it a tie, but the tank was totalled out by the Army vs about $50k in damages to the locomotive. Guys on the train were fair-to-middling hurt.

At sea the answer is "nobody". But there usually is a winner.

A vessel constrained by her draft is the closest to always having right-of-way.
