My mother is 66. She just got re-married. She is making a will to "protect" my brother and I.

She wants me to be the executor, because my brother would probably fall apart and screw it up.
I'm thinking that she thinks that if she goes before he new hubby that his kids will try to take everything.
She has 2 houses and some family heirloom stuff and collectibles, but not really any money.
Any money she does have would have come from my step-dad which was my brother's biological dad, so I think he should get first dibs on the money.

Does a will trump marital rights or whatever?
This is in Texas.

I've no clue what the laws are in your state, but I predict you will end up using that tool in your avatar to keep the in-laws at bay.
