Once again, trees are the victim... Neighbors just cut down two beautiful oak trees, I think the guy went through five chains trying to get these two beasts down.

The GF speculates they are going to clear that space, level it and use it for parking, which is tight in our row of townhomes and houses.

Lars has been lamenting the lack of quality content, this is all I've got. :shrug:

Trees too big, too close to the house, posing a hazard. I had several very large come down during Helene, one within feet of the house. Then I took down three more, same size. This was after building the house, careful siting to save as many as possible. After seeing hurricane devastation up front and personal, I decided that it was them or me.

I'd love to lose the oaks to the right, which is right next to our townhouse. Problem is our cat uses one of the oaks to get on and off the roof (much like the coons lol).

During my career designing home repairs I would determine the cause of the problem, when possible, recommend eliminating the problem then design the repair. Hundred of times, it was a tree, or trees. People love their trees, so I would ask a pointed question: what do you love more, the tree or your house?

Five chains? -- LOL. When one got dull he put on a new one on? :Jeff '79: He must have hit some metal and on top of that he doesn't know how to sharpen the chains. It ain't rocket science.

I had a bunch of black walnuts taken down around the yard by an Amish logger last week. I got a cool $2,000 for it, they're out of my way, can't fall on the house anymore, and I'll get another hour or so of sunlight on my garden. The log truck picked the last of them up around 6:30 this morning.

Would've gotten a lot more money but he had to rent a $1,400 lift to top them off -- because most of the trees were by the utility lines.

I don't get it either, part of the conditions (if they were enforced) to living on our lake is that you have to plant 3 hardwoods in the front yard in steamy Florida....after 25 years our entire front yard is shaded in the hot afternoons, newer neighbors lawns look like a ballfield with nothing outside and they complain about the burnt up, withering grass, sun destroying car paint, etc. You can't fix stupid.

There are also 'slow growth' formulations you can apply that will keep them from over extending for decades - have to reapply about every 3 years but no biggee..

25 year old mature trees and the product protects septic tank drain fields and pavement from being destroyed along with roofs and structures along with tree-killing root strangulation.....and arborist recommended.

Maybe find some other reason to be triggered ?

My house in upstate NY, purchased in the late 80's, was two acres of wind-swept grass cutting. I planted maybe 40 trees, mostly pines and spruce, but at least two black walnut. Last time I drove by it looked like a small forest.

Moved to Winston-Salem in the mid 90's and that neighborhood was 2 years old. One builder's special dwarf tree in the front yard and seven native trees in the back yard. Then a tornado and only one of the seven survived. So I created a nice wiffle ball field for my kids. Planted large forest trees in the front- magnolia and firs. Had to cut the firs down after ten years- planted chestnut variants given to me by a close friend. The magnolia is now huge- neighbors daughter collected leaves from it to make place holders for her wedding, and the softball sized flowers are intoxicating.

House here in the mountains, I carved out old growth forest- tried to save as many trees as possible. 6' wide lawn in front and none in the back. I gradually had to cut a lot back from the house. Helene took out a very large one that luckily missed the house. I cut down three more very large that were too close. Last month a wind storm took out another.

The only thing constant about life is change...

If there are more idyllic vistas than an old Florida pond with ancient Live Oaks festooned with Spanish moss, I don't know what it is.... Has a humbling and prehistoric feel to it.

Dumb shits that plant monster growing Magnolias and spindly fruit bearing trees near their houses in hurricane prone areas are morons - and many tract home builder pull that crap knowing it'll be problems for owners later on....

Then they suck in northerners that don't know better with disease prone, cheap Queen palms that need constant attention and drop nasty fermenting berries and generally die in less than two decades, when a nice Christmas or Foxtail palm is a bit more expensive but almost no maintenance.

I planted mine 20' off the street and 20' off the property line. . As it grew, verbal agreement with my neighbor to take over part of their lawn, pruning lower branches to keep from obstructing the road.

The best way to love trees is to love them in the woods away from the house.
Yeah it can really look nice having large trees near the building. And the old twisted oaks in Florida are really cool, and I have been able to save a few on properties I’ve built on.

But as nice as they are, they are nothing but trouble. If you have them and love them and are willing to accept the liability, go for it. I have. I wouldn’t again.

I also love to see them fall. And the sounds of the chainsaw triggers a lot of hurricane memories. Usually when trees are coming down something new is going up. I kinda like that too. :D

New place I’m fortunate to have acreage and my own woods. I removed every tree that could potentially hit the house. I have forest mulched a few acres around the house outside that strike zone and the larger trees I kept love it. The surrounding woods is thick and hard to walk through. I like it that way.

Wish my ever changing stream of neighbors would figure out the huge oak on their property between our houses is dying and the next big hurricane will probably take it down. I've told the last three it is dying, how much it's stance has shifted and they claim an expert said it's fine. Just like the two in the front yard the same age that blew over and took down the power lines for two weeks last hurricane. Saw the last expert nodding his head that the thing was fine and explained to him that I have been watching the tree shift, droop and die for 20 years longer than he has even been alive. But yeah, he's an EXPERT.

Felled trees mean progress - what a demented outlook.....it almost always means some old growth forest or pristine natural foliage is being destroyed to get that extra 1000 square feet of land for another high density POS apartment or townhouse. Its the reason you can't find a citrus grove near me anymore.

I would piss off greedy developers when I was on the town P&Z board because I'd make them keep ancient, healthy magnificent oak trees - screw 'em.

This angle shows how the remaining oaks hang over the road, but these old oaks have survived five hurricanes in the last number of years, we had three that came through in 2004, you Florida peeps will remember that. And two hurricanes since I've been living here.

If it retains soil, then it is a retaining wall. If it supports a building, then the 4' exemption does not apply (but is what the builder would use as an excuse to build it without a design).

Ask the contractor for a copy of the design for the wall. That will prove me right or wrong. But get ready to hear excuses, him say that I'm FOS, 'no one does that', 'its not going anywhere', whatever. I'll be a dollar right now that he will never produce a design by any design professional.

It may not tilt, depending on the soils. If it does, it will be several years most likely, in which case the contractor will claim its out of warranty, ignore your calls, if you hire a lawyer he'll hire one too. It will cost more in litigation to repair it and he knows it.

In Florida the county office of official records is where you will find the plat. It can be searched by book and page or subdivision name.

The plat will show the ROW and typically calls out ownership of the ROA.
The plat may note utility easements but easements are recorded separately.
Most easements and encroachments are better found on a property boundary survey.

Utility and access easements may be on the plat if the copy in the public records is an as-built document.

Yes, and it sure looks to me, based on prophecy understanding from listening and reading and praying, that it'll be coming up soon and very soon. Many do seem to now see it coming. you have to physically go to the courthouse to request the plat map in my county.

GIS sites may or may not show easements/right of way...I deal with it every day.
Every site I have been to has a disclaimer about the accuracy...and for good reason.

My county site actually shows the parcel vs the R/W fairly well...just ignore the aerial imagery.

Nature hates me.

Our neighborhood required at least one tree in the front yard.
We built in 2012 and I had a serviceberry tree planted.

Year two we had a massive hail storm come through, and the tree just stopped growing.
Didn't die, just wouldn't grow...at all.
Two years ago I had it replaced with another serviceberry tree.
Last year, we had another bad storm and it laid the tree over at a 45* angle.
I stood it back up, and it lives...but is not growing.

Damn thing is about to get replaced by a flag pole...

you have to physically go to the courthouse to request the plat map in my county.

For example, if the contractor pours concrete before the inspector has a chance to inspect rebar placement, the inspector should fail that portion of the work. It is now up to the contractor to prove that he build in accordance with the Code, or plans that supercede the Code.

Do you have copy of the building plans with a detail showing that section of wall? That's all the proof that you need here to "win" the argument.

Back when I still lived in civilization, I was building a deck attached to my house. Being in a subdivision, I had to pull a permit for the work. When the county inspector came out to inspect my post holes prior to me pouring concrete, he told me that they were fine, but I had to remove an empty beer can from one of them. I explained to him that it was "West Virginia rebar".


It was on that day that I discovered that county inspectors had absolutely no sense of humor at all.

The only “evidence” is did the home pass the necessary inspections during construction. And in particular the things that you can not see.
And, if the house received a C/O the whole story is over.

I've seen this same situation dozens of times and none of the contractors got it right. That's my evidence.

I know you've posted about your experience in court, so am I to believe that if you were on the stand as a expert witness, and you were there on the behalf of your client who is suing a contractor, that the court would accept this:

"I've seen it before therefore I'm 100% certain my client's contractor got it wrong..."

Is the court to understand that you have not examined inside the wall?

"Correct, your honor."

We're not in court. But if we were, I'd say that I've never seen a contractor get this right, so I have a hunch that this one didn't. But, since the Code requires him to have a design, and he has yet to come forward with one, the preponderance of evidence suggests that he never had one. :yesnod:

And if we were in court I’d say that you have a long history of bias against contractors, and I have never seen a contractor get this wrong, so I have a hunch that your bias is driving your position.
