Court Rules Against Social Media Companies In Free Speech Censorship Fight

A federal appeals court in New Orleans has ruled in favor of a Texas law that seeks to rein in the power of social media companies like Facebook and Twitter to censor free speech.

The decision by the 5th U.S. Circuit Court of Appeals in New Orleans (pdf), handed down on Sept. 16, upholds the constitutionality of a Texas law signed by Gov. Greg Abbott last year and delivers a victory to Republicans in their fight against big tech censorship of conservative viewpoints.

“Today we reject the idea that corporations have a freewheeling First Amendment right to censor what people say,” U.S. Circuit Court Judge Andrew Oldham wrote in the opinion.

“Because the district court held otherwise, we reverse its injunction and remand for further proceedings,” Oldham added, setting the stage for a showdown in the U.S. Supreme Court.

Groups Sue

After the law, known as House Bill 20, was passed last year, NetChoice and the Computer & Communications Industry Association (CCIA) sued.

The groups argued in their lawsuit that private companies like Facebook and Twitter have a First Amendment right to moderate content that’s posted on their platforms and decide on what forms of speech to allow or ban.

“The Act tramples the First Amendment by allowing the government to force private businesses to host speech they don’t want to,” NetChoice said in a statement. The groups also argued that the Texas law not only does not prevent censorship but allows Texas to “police and control speech online, overriding the First Amendment rights of online businesses.”

A lower court sided with the lawsuit and decided to block the law, with Friday’s ruling by the 5th Circuit Court of Appeals overturning that decision.

“The platforms argue that buried somewhere in the person’s enumerated right to free speech lies a corporation’s unenumerated right to muzzle speech,” Oldham wrote in the opinion.

He said the implications of the big tech platforms’ argument are “staggering” as they would allow entities like social media companies, banks, and mobile phone companies to cancel the accounts of people who express views or spend money in support of political parties or views such corporations oppose.

Oldham also said that the protections sought by platforms in challenging the Texas law would allow them to win a dominant market position by attracting users with misleadings claim of being champions of free speech but later cracking down on expression.
‘Massive Victory’ for Free Speech

Texas Attorney General Ken Paxton, who has been a staunch backer of the law, hailed the court’s decision in a statement on social media.

“I just secured a MASSIVE victory for the constitution & Free speech in fed court #BigTech CANNOT censor the political voices of ANY texan!” he wrote on Twitter.

Carl Szabo, NetChoice vice president and general counsel, issued a statement expressing disappointment in the appeals court’s ruling.

“We remain convinced that when the U.S. Supreme Court hears one of our cases, it will uphold the First Amendment rights of websites, platforms, and apps,” Szabo said.

CCIA issued a statement saying that the 5th Court of Appeals’ ruling infringes on private companies’ First Amendment rights.

“‘God Bless America’ and ‘Death to America’ are both viewpoints, and it is unwise and unconstitutional for the State of Texas to compel a private business to treat those the same,” Matt Schruers, CCIA president, said in a statement.

An appeal of Friday’s decision could put the issue before the U.S. Supreme Court, where conservatives have a majority.

Doubtful, it is a private website that you have to join. They will claim that they only suppress hateful speech. Which is somewhat true since every time someone calls Cumdog a douchebag they get banned. I stopped all visiting to PR&C due to the fact that only liberal speech was welcome.

Corvette forum is no more or less private than Facebook.

I'd join a suit against those assholes.

If anything like that occurs, the PR&C section will no doubt cease to exist.

Perhaps this one will pick up some of the expatriates, as the off-topic forum here has.

I was perma banned for asking why my thread was locked. And I asked Chem-douche nicely in a pm.

Chem got SaveWipe involved for some reason.

I did absolutely nothing in this particular case to earn the banning. Let alone a perma.

That whole crew of self righteous pompous assholes over there they call mods and admins can go right away and fuk a brick.

I know, Jim used to be someone you could work with, I got him to reverse a couple decisions that other mods made, over the years, but after the lib mods were brought in then they all collectively got their panties in a wad. And I agree about cumdog, he was a racist asshole before they gave him any power, and it all went to his head, cause he was the only one who was right. CD had made racist statements in threads, but after he became a mod those all disappeared.

I haven’t been over there in a long while now and don’t miss it but CD is a traitor to our nation. He is a textbook example of the “enemy within”. And I’d love to sue the shit out of CF but I think caution is warranted too, in that this is an attack on private property.

Not much of a stretch nowadays to see this getting used by government against all private property owners. Maybe someone is offended by your landscaping or such? Sounds crazy but I think we’re far beyond reason as a nation, at this point in time.

1st amendment is about the government limiting free speech, not private entities.
But I remember when there was an "equal time" policy, as when a candidates spoke on TV, the main opposing candidate got equal time to speak. That may have been a courtesy not a ruling though. Between fake "fact checkers" and dictatorial moderators social media is a biased, skewed mess.

You know what ! I've figured it out, we need a "Disnformation Governance Board" !

The first amendment reads:


“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.”

Government going after Facebook or Corvette Forum, for not allowing free speech, IMO, would make it an attack on private property not a defense of free speech. No different than if someone decided to enter my living room to share their political views. I hate the direction CF took but it’s private property and their right to do so. VetteBarn resolved the issue and I look forward to more membership in the future, as a result.

The “Build Back Better” nonsense being spouted by folks like Biden and other world leaders, is a global blueprint for eliminating private property: “You’ll own nothing and be happy”. I suspect any legal nonsense being initiated by the federal government, could be an effort to reach those goals.

Government is the problem, not the solution. Free Markets are the solution.

That's why I got the perma.... complained to bloatwave about just this, was told it was my job to provide proof and not his to look for it, and caught the ban. It's like all of his post history was scrubbed or deleted.

Well - from a hobbyist standpoint it riles me that so many people and newbies are getting bad-to-dangerous advice from the know-nothings over there. A ton of people with real world knowledge have been banned or quit posting..
Just a week ago one of the top 63 experts emailed me to say he was done over there...

Since I was shown the door at least 5 posters have gotten ridiculous advice about their split windows that will destroy any pretense of originality.

Many of us have saved data, screen-shot prints etc showing a MASSIVE case of censorship based soley on moderator opinion versus following specific guidelines which are also very subjective.

I'd prefer to see both the forum AND moderator held civilly responsible to those that faced obvious sensorship and what boils down to harassment IMHO.
