HATTIESBURG, MS - A former student at The University of Southern Mississippi who was shot at a Hattiesburg nightclub in November of 2010 is suing the business owners for $87 million.
He is claiming the business was negligent in providing "reasonable security measures." The lawsuit seeks $37 million in compensatory damages and $50 million in punitive damages. The lawsuit seeks a trial by jury.
Martez Smith's lawyer filed the lawsuit in Forrest County Circuit Court Thursday.
Three members of the USM football team were shot outside of Remington's Hunt Club in Hattiesburg in the incident.
Sgt. Allen Murray with the Hattiesburg Police Department said an altercation took place inside the Hunt Club off Highway 49 around 1:20 a.m. which then moved outside of the night club where one person opened fire injuring the players.
Martez Smith received his degree in Interdisciplinary Studies during graduation ceremonies at the Reed Green Coliseum in December of 2010. He is wheelchair bound as a result of his injuries.
